Item (still!) not received...

Hi guys,
I am wondering if you can give me some advice as I am only a relatively new eBayer. I ordered an item on the 18th February, so it's coming up to a month now pretty much. I didn't receive the item within the first 2 weeks so sent the seller a message asking for options, and he decided to send another, which I was happy with. Two weeks later, still no parcel. Following his advice, I contacted the sorting office who said there was nothing there, and even went down in person today asking again - still nothing.
The seller sent me a message saying the first one has come back to him saying 'REFUSED' on it. I don't know why - no one has refused a parcel (nor could they have?!). Royal Mail were clueless when I asked them about it today and said there should not be any problems with me getting post, and just to contact the sender again.

After 3 weeks I asked for a refund but the seller (a power seller) seems reluctant. When I e-mailed him today he was pretty annoyed that it has come back to him and that he is wasting money - but I don't feel this is my fault. I am just annoyed that it has been 4 weeks and just want to give up and have my money back. What should I do in these circumstances? How long do I get to claim the item not received?

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    Hi,
    Thanks for the replies.

    I really wanted it delivered via Royal Mail. I'm not in during the days and all the courier depots are quite far from here and I don't have a car. The RM office is only around the corner so it would have been perfect.

    The address has been double-checked and it's correct.

    Is there a maximum time period for getting a refund?

    As you are not in during the day I can only guess your post person is not leaving a calling card when returning the parcels to the sorting office. Might be worth having a word with them to stop this happening in the future.

    I thought this too but have been ringing the sorting office nigh on daily, but they have nothing. Aren't they supposed to keep it there for an allotted period of time before sending it to the sender anyway? It was sent normal delivery, if that makes any difference.

    I think it's only one week for normal delivery. It would still have info on the package though, telling the sender why it was returned.
    I feel for you both, I've been a buyer waiting for somethin to arrive. But I've been the seller who gets an item returned too. Although thinking about it, what happened to the other item he sent out? This was the second wasn't it?

    After an attempted delivery a normal packet is kept for 3 weeks before being returned to sender.

    I would be questioning your postie to see why it was refused. Has he perhaps gone to wrong door? Of course, it could have been an accident or a new postie on the duty and has put wrong coloured sticker on parcel, custardly will confirm this happens. If it's had a red sticker put on instead of a white one (gone away, refused, etc etc) then it would be returned to sender immediately.

    As for the paypal side of things. Although this isn't the sellers fault, it certainly isn't your fault either. If he's not going to send another get him to refund or open a dispute.

    You cannot harass the seller for this item - he has already sent two items for the price of one, it's not his fault that the RM has failed to deliver on both occasions. It is just possible that the package has been mis-filed at the Post Office depot. This has happened to me once, I had to really badger the guy in the depot to thoroughly check every pigeon hole and location where someone might have mis-filed it. It did turn up eventually in totally the wrong place. Also, a neighbour might have taken it on your behalf then forgot all about it.
    If the seller has a POP certificate you will have to use that to claim from the RM. Or, if it's not too expensive an item the seller might split the loss 50/50 with you - though he is not obliged to do so.

    No its not the sellers fault but as you have not received anything then open an item not received dispute.

    No reason why you should foot the bill or go 50/50.
    Please do not quote spam as this enables it to 'live on' once the spam post is removed. ;)
