Letter 3 (JUST ADDED: newer edition of Letter 3)
Letter 4 (Court Proceedings Ltd.)
Letter 5 (Court Proceedings Ltd.)
Also they have 7 County Court Judgements in their favour 4 of them in Liverpool! Hmmm!
The head is missing on the ticket side 1 which states you can have a ticket for:
1: Without valid Permit or Authority!
2: Out of a Marked Bay
3: On a yellow Box Section!
4: Beyond a stipulated Time Limit!
5:In a Disabled Bay With No Badge Displayed!
6:Leaving site
That last one is no joke , it actual says this!
The Ticket Demands money £100 to be paid or £60 if within 14 days. The Said Ticket does not state that it is for a breach of T&C, it misrepresents itself in my opinion as it a notice of a breach of Terms & Conditions 's not a statutory parking notice from the police or Council but the Ticket never states that it is a notice of breach of terms and conditions.
The Parking Notice Charge two of the ten conditions:
Par 7: ...the Police must not discourage payment...
Part 9 : Due to legal reasons it will be difficult for UKCPS Ltd to submit verbal evidence in court.
Therefore we regret we are unable in to verbal communication...
Acording to the Misrepresentation's act 1967
Section 2 (2) (2) Where a person has entered into a contract after a misrepresentation has been made to him otherwise than fraudulently, and he would be entitled, by reason of the misrepresentation, to rescind the contract, then, if it is claimed, in any proceedings arising out of the contract, that the contract ought to be or has been rescinded, the court or arbitrator may declare the contract subsisting and award damages in lieu of rescission, if of opinion that it would be equitable to do so, having regard to the nature of the misrepresentation and the loss that would be caused by it if the contract were upheld, as well as to the loss that rescission would cause to the other party.
If people still have there ticket and a Person should take them to the county Court and win? Would they have to pay back the money they have already taken from people?0 -
Taffy (a fellow Taff here ) I see you are telling this member to still ignore them even though they had written to them and armed them with info .. I did exactly the same when I received my 'letter' on Friday .. (yes the 13th) .. it was my 2nd letter according to them and my final notice .. it is listed as a Traffic Enforcement Notice which makes it sound very 'legal and real'. I had a reply from the store customer services on Saturday, they agree with me and suggested that I take it up with them but after reading the case of the man re the Homebase fiasco and his problems, I am not so sure that they will be sympathetic enough, however, I realise it is not wise to second guess this as I may be wrong.
My daughter and I had spent nearly a £100 in that particular store that day. Then the previous Friday I was there with 2 friends and between us we spent over £200. It has left a very bad taste in my mouth about shopping there again. My 'fine' is £150 because I did not respond to 1st letter ( as said above.. not received) and they will accept £100 if I pay it in next 7 days. I heard from the car parking people today in response to my 'appeal' and they have refused. I feel so angry about this and companies like them. The majority of us I feel really do not deserve these fines, given that we are lining the pockets of the very stores affiliated to them. Do I still ignore them now given that I have sent and received correspondence? Thank you.0 -
Well the advice now is to ignore them, they won't take you to court it's just going to drag out longer as you have communicated with them, the invoice is not enforceable, and a private company cannot fine you.

My daughter recieved a letter on Saturday from Debt Recovery Plus stating she had been written to previously (no other letter has been received) and want her to pay £148.99 for parking. I phoned them today and told them no other letters have been received and they say that its Royal Mails fault and to take it up with them. I was going to write and appeal to them, but now I have read the feeds on here saying dont pay these people. Should we pay as I have made contact and they now have our home number.0

It's now more than 4 months since I received my last letter from Athena and their debt collectors. Not a word from them since.

hi i got a parking charge notice. from xlcel parking on the 28/3/2011.
i had 14days to pay £40 so i sent the money on 11/4/2011
and they sent me a letter saying it was not received in the timescale.so thay wont me to pay a additional £60. but iam not going to.after reading some of the post on here.but i wont to get my money back how do i go about it.:money::j0 -

No chance. Only if you took them to Court, not worth it. You were had and it makes me mad because you've now funded the victimisation of even more people.
