I appreciate that is your opinion, but legally (which i believe is what is important) I highly doubt theft could be proved, unless the OP could prove that the Co-op had not passed the note on to BOE or the police.
Have a read through the theft act 1968 as it clearly defines what constitutes theft. The member of staff was obligied to retain what they believed was a counterfeit0 -
Just have and posted a link above and the relevant paragraph about apropriation. Also how can the CoOp staff prove any fake note passed to police was the one taken from the customer? That is an issue i raised.
1. Only the co-op can tell me the note was passed on (i called the police who said the co-op should give it to the bank and the bank will then pass it on to them)
2. I cannot prove the note handed over (if it was) was the note my friend gave and
3. All the bank can say is that the co-op handed a fake note in. They would not provide me details of how the process happened so whats the point of telling the police if the information is so limited they cannot act on it or find some trace as to where it came from.I get what i want. That isn't because i'm a brat or spoilt. It's because i'm determined, i work hard for it and i achieve my goals!0 -
My GF had an incident a few years ago when the manager of a cafe insisted a note was fake and was doing this strange flicking the note and in the middle of a crowded cafe going "fake" "fake" the police have been called. My GF was in shock but lukily my friend Gordon said, "well it just came out the cash machine over there and maybe you should be waiting for the cops to arrive before you start making it public and embarrasing innocent people?".
The police turned up and the note was genuine, the manager was told that you can't find out if it's genuine or not by flicking it.

Again a point i raised. I 'special pen' cannot 100% prove the note is fake. And the co-op cannot deem the note fake. they may only withold it on the 'belief' it is not legal and pass this on for further testing (which i agree with)
My problem is
1. I doubt all cashiers have been suitably trained to spot fakes and
2. Regardless of whether it's fake or legal, my friend will not have it returned due to their refusal to take her details. So the co-op have what i would call, overstepped their authority.I get what i want. That isn't because i'm a brat or spoilt. It's because i'm determined, i work hard for it and i achieve my goals!0 -

As i am not a lawyer i cannot be a 100% sure as its my interpretation of the Act... the point your forgetting is the note was believed to be non legal tender? therefore is not the belief of the person who took the note that they were passing it on rather than an intention to become the owner. Also IF the note was conterfeit then the person who was using it could not be classed as "the owner".
An example of this being when someone accidently purchases a stolen vehicle. If the police seize that car you are not enititled to keep it because you paid for it or are the owner, just as much as the person is not enititled to the monetary value.. the car is taken end of and the "owner" is no longer the owner.
I think the most improtant thing here is that the member of staff should have got the manager involved and they should have written down the persons full details and the serial number of the note. They then should have both had a copy
if the note was then proved conterfeit they could trace the note back
AND
if it was proved not fake it could then be returned to the "owner"
If you are right (and as I have said you may well be, but I beg to differ) then why have the police not arrested the member of staff for theft and seized the CCTV as evidence....0 -

No because his calling the police proved intention was honest if misguided. His manners and people skills were slightly lower than a horse that had just been figged.
In the co-op case we have no proof the same note was handed over therefore no proof the fake came from the OP's friend.
