    As a newbie, can I ask a question which I am sure most here know the answer to, but am sure newbies would like to learn a bit more of.

    Looking at your joining date, you have not been here since the year dot, but you clearly have either had, gained or both, alot of knowledge in this minefield. I'm under the impression that it was not a debt issue that brought you on board initially, but you have certainly taken the bit between the teeth with regard to fighting for the person on the street and there are alot of grateful people out there, not just for the advice you give, but the support to stick to the battle and come out winning.

    No, i've been here just over a year - can you find my first ever post? It was about HSBC if I remember correctly - but then the Unenforceability thing became bigger and bigger and I guess, being that I know most the rules of the CCA1974 and CNCD Regs 1983, I felt obliged to get involved.... things just progressed from there really and now everytime I try and walk away I get roped back - hmmmm

    I have never been in debt, no. I was the victim of ID Fraud - basically lost wallet, someone found it and used my details to apply for everything (including the kitchen sink) - then a year or so later I found out, it was over £150k and by that point I have multiple CIFAS (Fraud) warnings, 50+ defaults and several hundred searches so in essence, nearly cost me my new house....

    Sooo, a long 3 year battle ensued - I won. I fought the banks (all 15 lenders) and the CRA's - as things stand right now, my credit file is fine with 9 active accounts, no defaults or anything but one incorrect linked address and the cifas from my own bank, HSBC.

    That's about that really - so no, never been in debt but you know what hurts more - when you know you're innocent but struggle to get anyone to listen - trust me, court threats do work - lenders are not so keen to fight when you serve them a claim form, however you have got to be 100% right in what you say or they may well call your bluff - I wanted them to take me to court, but they never did!

    The reason I help (or try to) is because I am one of a few people on here who understands the full implications of s.78 (and the CCA in general) plus its hard to walk away as i'd be leaving people in shoite - not really fair on anyone, so as things stand so long as I don't keep getting hassle then i'll stay for a bit, otherwise i'll be off - just as fast as when I joined.

    Moral of my story, don't start something unless you're willing to see it through - I made flowcharts for ease, but most newbies ignore them and PM me or go straight in with a question, whereby if they spent an hour reading (I spent 2 whole months studying this full time before writing a single letter to ensure I had all the facts and knowledge) they would know pretty much what to do.... frustrating at times but i've made the rod for my own back. :p

    thank you for that. sorry about the 4 adult thing, they get refered to as adults all the time now and I get told off for not letting them grow up !!!! Hoping I can make some changes with the advice I got yesterday, really grateful to all who posted, not sure yet about the unenforceability issue, worried I might make things more difficult for us. I'm going to check out your thread, thank you

    I understand what you're saying but in the realms of financing and family affairs, there are two adults and X non dependant children and X dependant children...

    basically your kids finances do not form part of yours ergo they are not classed as adults in the conventional sense.... if you see what I mean? :D

    I did think you were winding us up at first, I mean 4 adults seems extreme (my mind was racing trying to figure out a non sexual permutation) - but I kept coming up with the same thought, its a wind up! 3 adults maybe, some people do like to share, after all :eek: :rotfl::eek:

    Wow, how frustrating for you. I've had my card cloned a few times, but nothing like the value you had to deal with.

    I am genuinely a newbie. I so wish that I had been aware of the site a long time ago, it would have been less painful. My LBM is genuinely in reverse. I realised about 2 1/2 years ago that I needed to start dealing with my debts and simply set up repayment with no idea of how much I owed. Realised shortly after I joined the site that by the time i finish in Jan 11 (not that I am counting!) I will have paid of the best part of £30k. Scary when I think about it now, but not as much as it would have been if I knew the amount beforehand

    read my thread back and realised how bad that 4 adult thing sounded!!!! what was I thinking?? actually, at the moment there is very little sense in my head at all....resolve to be far more careful with form filling as well as keeping tabs on purse!!

    Thanks for sharing your experiences with us all.

    I, probably among many others, am glad that you find it hard to walk away! Plus, I have to confess to being one of the "newbies" who asks a lot of questions. But I do think you realise how grateful I am for all your help!
