Looks like i missed all the excitement!
The vast majority of MSE'ers don't throw stones mouseann - we've all made mistakes and are doing the best we can to fix them. You are in a slightly different position because your options are so limited.
As i said earlier, there are a few different ways to go about this. NID has a very informative thread which answers just about any question that comes up now and it is probably best to just follow him through it step by step.
FOR INFORMATION ONLY (so NID doesn't shout at me)
With the CCA request most creditors will now just send back a reproduction of the agreement. This document if it does not have your signature on it will not be suitable for court use - it will only be suitable for them to meet their legal requirements in connection to the request. Very few creditors send a copy of the original document.
Don't worry about this. The only reason i ask now is to see if you have the means of scanning letters or documents so that they can be displayed on the forum (without your personal details). It might be useful to be able to do this but just so we know now incase you start to worry about things coming though your door.
If you are sent a reproduction, this is not an enforcable agreement so they would not be able to use this in court should they try to take things that far. Don't worry about any letters threatening legal action either. They will all say they MAY take legal action rather than they WILL. If any of them did want to go to court, it is important you ask us questions as you will need to defend yourself. You need to argue the law - a judge cannot just take action on the law he knows. You must present the arguments - which in the majority of cases is the section 127 i mentioned earler.
I'm rambling and NID will probably go over all this when it becomes more relevent. Just want to forewarn you a little.
Keep us updated with how things are progressing, when you've completed the various steps you need to take and how you're doing/feeling.

Actually, I am going to invest in a printer/scanner this tomorrow - I have some vouchers given to me as a retirement present, so this is not an extravagance.
I take your points about knowing how to argue - this is when I will rely on everyone on the board for their help and advice.
Not sure how to post attachments to the forum (wasn't even sure it was allowed!) - I was going to use something like Google docs but only give the password and user name to individuals by PM, e.g. those who are able to help, such as yourself and NID.
Since last night, I am a little concerned about who finds out what - if you get my drift!
And I will be posting regularly, especially when things get hairy and I am in need of comforting words!

Please try warmfront with regard to your heating. I had my boiler replaced by them 18mths ago. At that point the boiler was not quite dead but clearly terminal ! I know you havbe storage radiators but they may be able to do boiler & new radiators. It's worth asking0 -

Hi Mouseann, have been reading through these and can quite understand how you've been feeling - we are 63 and 59 and only had the LBM in Feb, with at least 5 years to go before we're debt free.:(
You have come to the best place - and will get all the support you need, and as many have said before don't ever be afraid to post - we've all been there!!!

Moving on, just email me any docs that come and i'll reply via email - so all you need to do is scan them and then attach to an email (easy). My email is {{{ removed }}}

You will never have to go to court, George was warning you of the different responses you'll get - but do not worry, email me the letters and then we'll keep them hidden as lenders do trawl these threads, as mentioned last night two people from my UE thread have posted a letter with my name on it (i.e. never-in-doubt from MSE)... one DCA(Moorcroft) even offered me a job by PM - we had his profile PPR'd quick enough though :rotfl: :rotfl:

Excellent post - all makes sense and good reading, easy to understand as well. You know how it is, hard to make something so technical fall into "Plain English" - but you've mastered it here
I'd never shout at you, tsk - you're like extremely knowledgeable in this field as well.... don't take that away from yourself mate. You've helped as many people as I have, just that we stay in different area's of the forum
I think this will be quite a battle, as you say they will start throwing all sorts of threats around but that is the key point, they are nothing but threats!

Bear in mind, you have the power to have them removed, if they turn up at your door - you have the power in everything that happens from now, not the lender nor the DCA. Do not forget that, if you want i'll give you my number and if anyone turns up at your door ring me and i'll tell them to get lost for you (within the parameters of the law of course)...
