I took out a Morgan Stanley Credit Card in 2003 that has changed hands to Barclaycard. I am definitely going to ask for my true copy of CCA.

But Niddy is right about the default - if you have my thread you have probably realised that I have very little to use (including my reputation) which is why I am going down this route! Don't want to repeat the story yet again!

Ok, it does look good.
Like finding a needle in a haystack, so right now lets try and confuse them and let them explain to us why they think it is enforceable. Actually, it is (shhh) - but i've seen a couple of wee faults, which in themselves is not enough to win in court - but it would be if I went to court, however we don't entertain that notion usually. I think it'd be prudent right now to send this off: CCA Query
See what they come back with. Primarily, they have sent the application form and several sets terms, which luckily do conflict with each other none moreso than one being illegible and a clear copy/paste and the other seems to be the most recent version. That is good, but not when it was not a variable agreement to begin with.
I suspect they think that the application form complies, to an extent it does but not really because although it does link to terms, it does makes it clear that these should be on the reverse. I personally think they will have a fight on their hands unless they can send an actual copy of the original to you. That's what we will go for right now.
Faults to date: No CCA, the PT's are not linked to and embodied within a signed agreement and the form does not have a *lender signature nor the *limit
*(these are the two things that alone cannot enforce unenforceability).
However without me stripping their terms apart, its not worth the hassle, we'll go on the basis that this one is a good 50% enforceable or 50% unenforceable, however you look at it. So right now, you need to see what they actually do have - thus we'll ask!
Send this CCA Query and see what happensBut do not worry, this is one problem out of 17 so it's not too bad.... we'll see what they come back with in their reply...
