    PLEASE HELP! RE PARKING EYE CHARGE.(chester)

    I have received 3 letters (including photo evidence of my car plate) saying i'd overstayed the 3hr period by 35 mins.i'd never even saw the signs! i stupidly appealed (under medical grounds for newly diagnosed joint disorder ehich ive provided proof for) and basically admitted i was there in my car on that day and have paid the fine this morning via visa £92.50 (cos i did't pay in the time for the reduced fee of 60.00) i have cancelled the payment but even though ive admitted being there and purchased goods on the day and sent the receipt? can i still refuse to pay it? any advice would be great!!!

    How did you cancel the payment? If it was done though the card issuer, verify with them its been cancelled and that it should not be reinstated.

    I've just received a "Parking Charge Notice" from ParkingEye.

    I note the strong advice on these threads to simply ignore all demands & correspondence. However, I did also see one post that said that one shouldn't ignore it when it is received from a private company contracted by a local council.

    The fine was for overstaying my time in a "Shopping Centre Public Car Park" which is free, but which also has a time limit that I wasn't aware of. As this car park is presumably owned by the local council, does this make a difference to the general advice on offer?

    Very few of these tickets are official council tickets. If it is a council ticket it will say somewhere on it that it is. If it actually says on it "Parking charge notice" as opposed to "Penalty charge notice" it is more then likely to be a private ticket. You can ignore that one.

    Further to my earlier post, because I have free access to a legal advice line manned by fully qualified solicitors, I decided to run it past them for peace of mind. However, what he said is totally contrary to the advice given here, and also apparently by the BBC Watchdog solicitor.

    He does agree that their only course of action is to sue under breach of contract. However, he reckons that they'll almost certainly have photographic evidence proving conclusively it was me and he knows of a LARGE number of cases where private parking companies have successfully sued people.

    His advice to me is that if I know that I'm guilty then I should just pay it. This partly seemed based on a moralistic approach (although he's there to advise me legally, not morally), and also to prevent the risk of the costs spiralling out of control, especially if bailiffs get involved.

    If, contrary to his advice, I want to be "pedantic" about it and attempt to wriggle out of it on a technicality, then I should request copies of whatever photographic evidence they have of who was driving, so I can determine the extent of their proof. Certainly, to simply ignore all of their correspondence would be totally CRAZY in his opinion.

    Any thoughts?

    No wonder its free advice, he could not charge for that crap. I hope his chosen field is not contract law!

    I would say ВULLSНIT LAW.

    The facts are there at everyone's disposal. Private companies demand extortionate sums, they stalk registered keepers, engage in harassment, and what's more, they know better than to even try to obtain their claims in the courts.
