Yes it is it. But the possibility is about 0.00000000000000001%

I have read forums on this subject but now following this advise from CAB I feel even more confused...

Forgot to say the CAB chap said they DO take to court...

What you have to realise is that CAB are always going to err on the side of caution in their advice.

On the other hand, whilst you may, understandably, be wary of advice given on the internet by unknown people:

    a) there are literally thousands of post across all the consumer forums that basically give the same advice - ie ignore

    b) if this strategy was fundementally unsound , there would also be hundreds of posts saying something to the effect " I took your advice to ignore and now I've been taken to court and owe hundreds of pounds". But that isn't the case.

About 730,000 requests for keeper details are made to the DVLA each year.

So assume 30% of people pay up straight away, that gives us 949,000 tickets.

There are about 40 court cases each year.

That gives us a rough % of being taken to court of 0.0042%.

The precise PPC makes a difference to this. A PPC that has never ever taken anyone to court will lower the number, compared with someone like OPC who used to take about 25 people to court a year.

Parking Eye are one of the biggest requesters of RK details and have made 2 court claims in the last year, so assuming they issue 25% of tickets, that gives us 237,250. That gives you a 0.0008% chance of court action.

This may increase if they read this and see your details, so I'd scrub out any timing and location info.

But out of the 40 or so court cases a year, the vast majority go against the PPC if you put a defence in.
  • I could really do with some good advice asap. On the 20/12/11, the day after coming home from hospital due to liver/pancreas failure, I had to go to the pharmacy at Boots on Aintree Retail Park to pick up an urgent prescription taking my young daughter with me, that I needed for the next day for a full CT and MRI scan. Obviously with it being xmas the car park was very busy. I waited for a disabled bay (I have spinal injuries after being hit in a ‘hit and run’ accident). After nearly half an hour none were available, so as per Blue Badge Policy I parked on double yellow lines and displayed my badge in the legal manner. There were other cars parked on the same double yellows with no blue badge. I was literally 9mins in the store. As I exited the store I was greeted by a lady telling me I had been given a parking ticket and said she had told the warden that she also had been in the same position as myself and had watched my attempts to try and get a parking bay close by.
I then asked the warden why I had a ticket as I had displayed my badge correctly and why the other cars hadn’t. His response was “ this is a UK Parking Control LTD car park, the other cars had passengers (children on their own) and that normal blue badge rules do not apply here”. I pointed out a car on the same yellow lines was also blocking a pedestrian crossing and asked what the difference was. His response was that it was up to his discretion and that he didn’t have to explain to me. I have appealed in writing and am waiting for a response. The ticket will cost me £90, which is more than I have to feed myself and my children for a month. Any help or advice please, I am really worried about this.

Private = ignore, ignore, ignore some more.

Really, truly nothing else about your case is relevant ...simply ignore everything from them.

    Yes...I mean it.

    Seriously...ignore it all.

    hi harrassedmum

Helpful advice - you have already posted two separate threads in the main forum:

    1. https://forums.moneysavingexpert.com/discussion/3749909

    and

    2. https://forums.moneysavingexpert.com/discussion/3749899

It will be easier for you to follow advice if you leave everything in one thread. Spreading things about only results in the advice being diluted and gives you a lot of extra work in trying to flit between the individual threads.

I suggest you pick one or other of those above (perhaps the one with the most replies) and direct everyone to that to keep it simple. ;)
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
  • I have receieved several letters asking me to pay a parking charge from parking eye over my car being parked in Sunderland Royal hosp.
On the day in question i was at work.
I then received another letter telling me that if i didn't pay the charge or get the driver who did enter the hosp car park to pay the charge, they would take further action against me by either bayliffs or court procceedings. I have on several occassions informed them that i refuse to pay and they keep telling me that my appeal has been unsuccessful. They have just sent me a final letter demanding payment and if i don't pay they will take action against me. they also stated in the letter that is was the last time they would contact me. I have replied to the letter informing them that i will take action against parking eye and or persons acting on behalf of parking eye for harrassment and report them to the authorities if they contact me again. i have also informed them i will not be responding to any more correspondance from them.
I am standing firm on this and won't pay them a penny.
