OK just an update here. After Loancheck went Bellyup Watson would not respond to my letter etc about my case against Lloyds. Now they are being investigated by SrA and we have been awarded compensation. 550.00 which was a bonus.

Have just heard back from Lloyds today they have upheld the complaint and are paying back about 3200. plus Interest plus 8% this goes back to 2001 and was settled early in 2005.

So all in all a very good result. Even though this went through FOS Lloyds have sorted it themselves.

I also have a complaint against Watsons with SRA going on, but am worried that they may not take it on, as I haven't gone through his complaints procedure. I sent all my paperwork in with a letter stating that I continually tried to contact him by recorded letter but he never replied back, so hopefully they will look at it and I have a result like you.

It will give me as much satisfaction to know that he is getting black marks against him awell.

How long did it take for SRA to conclude your complaint and give you all your paperwork? I just want confirmation that he isn't going to pursue me for money owed, when he done absolutely nothing on my case for the year or so he had it.

Mine too is being dealt with by the FOS, but have had to go against the insurer Lloyds, as the broker route was a dead end as he was not regulated. Fingers crossed.

    Hi Millwallpaul

Well done for going down that route. I did go down his complaints procedure route which he ignored. I then went to the Complaint Service through the SRA. They will help you with the procedure. Basically once I put it in their hands I have had to do no more. He would not return my paperwork and they wrote and told him that if it was not returned by a certain date they would get special carriers in to go into his office find it and take it away. By all accounts an expensive and disruptive procedure. Anyway they responded to the complaints service and returned my paperwork. The SRA are involved in seeing if he has broken any regulatory procedures and are carrying out a full investigation now which he has to answer to. The Complaints service have awarded the compensation. He has not responded within the time given (7 days) so am waiting for their next letter. By all accounts we can then claim through their insurance which will then hike their premiums up. Must be about 3 months now. Lloyds at first did not uphold complaint but after explaining to them that they had refunded Business Overdraft Insurance for the same complaint they relented and upheld decision.

Good luck and let us know how you get on.

  • Legal complaint service won't take my case on any further as they say I didn't contact them within 6 months of the problem occuring.

I have tried to argue that I have sent emails & letters to Watsons asking for clarification that my contract was cancelled after the date they are holding me to for it to be time barred, but they will not have it.

The only thing they will do is contact Watsons on my behalf to ask for written confirmation that my contract was terminated and for all my paperwork to be returned, so better than nothing i suppose.

Thats a bummer then millwallpaul. When should you have taken the complaint to them then? How long after the time scale did you take the complaint to them? I would think that it would be same as FOS in that you only just became aware you had a complaint and these rules would apply??? (section 32 limitations act I think). Don't really know how this works with complaints about solicitors but surely as you did not really know you had a complaint as such they should look into this on that basis. You just assumed they were busy on your case didn't you????

Blimey that is not good. Sorry about that MWP.

Mine has gone through the system and the SRA are making a decision about regulatory issues. I have been awarded 550 from the complaints service. Watsons have ignored their requests to pay the amount so through the SRA I have gone back to the Insurance Company who sent a letter out the other day and asked for the details of the account it had to be paid in. I got the person who I am helping to claim for to ring and the insurance company told them that they were not going to pay out as Watsons had only been with this particular company since October 09 and the complaint goes back further.

So they are playing silly buggars thats fine I can be patient and keep on but it is very tiresome.

Just an update. This went from Loancheck to FOS with copy to Lloyds. Lloyds at first dismissed complaint. I explained to them with a copy to FOS that they could not reject complaint because they had already admitted mis selling a Business Loan Repayment Insurance and refunded the difference for the same reason that we were claiming on the Loan. The loan went back to 2001 and was settled 2005. Although we are still in "dispute" with Watsons Insurance Company about paying the compensation awarded by the Legal Complaints service we have now got the PPI back from Lloyds totalling just under £6300.00 so result.

If the insurance company do not pull their finger out I suppose it is off to the FSA to complain about them. It is a long running Saga but am sure we will get there eventually.

1 Down 1 Loan that was with Loancheck still to come to an agreement. Another Loan just going in and Credit card awaiting decision from Ombudsman. This has been going on nearly two years now LOL. Complaint was upheld but Lloyds being awkward.

  • Hi all

The Legal Complaints Service will definately not take my case on as it is time barred. I wrote another letter stating about only recently finding out that I could use them for some redress against Watsons and that I have had contact with him after the date they are holding me time bared from, but no joy.

I am going to complain to the Legal Services Ombudsman, who they have directed me to if I was not happy with their decision. Hopefully they may look at my reasons a bit more favourably, as we are only talking about 10 days outside of the 6 months time bared. Fingers crossed.

One good thing is that Watsons have confirmed that my case is closed with them with no money owed, so at least it closes that chapter of this ongoing saga. Here praying that Lloyds insurance now pay up.
