I didn't think it would be too long before others reiterated my points. Those in doubt take heed; doing things "right" is no guarantee NOW with E2Save. And "simple" is not in their vocabulary.0

I also claimed correctly and was refused. E2S backed down when threatened with LBA pointing out that they had changed the T&C. MJ's advice was helpful.0

Actually, why bother posting links just three pages back for someone who thinks it's ok to just pop in and out and not waste their time keeping up to date? I learnt a long time ago that good advice and effort falls on death ears with those who prefer to spend their time attacking those who spend theirs keeping up to date and actually trying to help people based on the here and now rather than the limited past. I say let them do their own research rather than rely on ours! I am not attacking you - merely making a small point. Those who aren't as familiar should really listen to those who are and not the ones who aren't if they are to avoid problems. I have seen this happen many times and THAT is what's really boring! Lol!0

I have bought new mobile contract from E2Save through Quidco in March, and still waiting for £36.50 cashback from Quidco. Twice send complaints, but they have replied that my order and customer ID were not matching; it was silly every thing was correct; they just don’t want to pay this cash back.
When rang to E2save, they said that they wont offer any money thorugh Quidco.
I think E2Save has stopped paying cash back through Quidco, also they are very tricky in all usual cashbacks. Please be careful.

Received my brother's first cash back cheque for £90 today. He's on a 'Price Match' deal. Posted Special Delivery on the 12th May was then redirected and delivered on the 14th May so a turnaround of well under 2 weeks.
Maybe they are trying to clean up their act with all the MCOL claims that have been made and all the up front cash back they are having to pay with all the court costs too. Just don't let them fob you off I certainly can't afford to lose any of my cash back.0 -

To summarise, I took out a Price Match Deal through OneStopPhone Shop (part of CPW) in Aug 2007. I submitted my first claim and it was refused because I sent a copy of by bill rather than an original
I have disputed this because I was sent through the post terms which say a copy is acceptable and emailed terms which state that a copy is preferable to an original. In addition I telephoned the helpline to check the details and my strong recollection is that I discussed sending a copy rather than an original.
OSPS are citing terms on the site found under 'my account' that state that an original should be sent. However, the PDF file was created 5 weeks after I took out the contract. I didn't view it before they disputed the claim (hindsight is a wonderful thing)
Having sent an LBA then issuing a court summons they have offered a settlement 'without prejudice' of £233, plus I can send claims in for a further £90. The total cashback for the year I should have received would be £495, so this leaves me £172 down if I accept this.
If this were a straight 'they're refusing to pay me and they're breaking the terms' then I would definately tell them to get lost.
The decision on whether I get paid will be down to a judge deciding if I have reasonably followed the terms indicated to me by post, email and telephone conversation whilst they will be citing Ts&Cs that may or may not have been present on their website at the time of purchase. It is not therefore clear cut.
My next step will be to contact them to demand an out of court settlement for the full amount. If they refuse, do people (especially those experienced in contesting these descisions) feel that I should persue this through court or accept the lower offer?
Just a bit of feedback incase anyone is interested. My problem wasn't a simple case of them refusing to honour a perfectly valid claim as there was the added complication that the terms that they were claiming applied were not made explicit to me at the point of purchase.

After submitting my court claim I was emailed by e2save with an offer of £233, which I rejected. Today they offered me £396 which i rejected and 10 minutes later they offered the full £500 (without prejudice) by cheque without needing to send in any further claims.

If you make a reasonable attempt to claim the cashback, even if you get the claim wrong, I believe you would still win in court. Magistrates take a hard line with companies that attempt to confuse their customers with overly complicated contacts. In UK law any contract must be reasonable.0 -

Read the thread and you will see this offer is their regular "solution" to stop further court action.
The "without prejudice" seems significant, as it is reported often the cheque doesn't turn up.
Did she promise the money by a certain day?0
