two lodgers now asked to leave as refuse to pay rent

HI everyone

Was on here yesterday.

I have now asked my 2 lodgers to pay the rent or leave (they wanted to use deposit as last months rent

They said they cannot afford the rent , when I asked them to use their overdraft facility to pay rent they told me to use my overdraft facility if I was having problems with bills as a result of there non payment!! !!!

They are going to move out but are demanding the deposit back less bills even though I am out of pocket this month if I give them back deposit less bills.

Where do I stand with this??

Surely deposit is for this very reason ? or am I wrong??????

    You are right.

    And as was repeatedly explained to you in your previous thread, IF THEY DO NOT PAY THE RENT YOU CAN EVICT THEM. TODAY.

    Get a friend round, tell them to pay or leave. Then put their belongings outside and change the locks. As for the deposit, tell them that once they have left, you will calculate the bills and deduct from the deposit, also deduct any damage, and then you will post them a cheque to their forwarding address.

    The advice has not changed since yesderday!

    ps - I also now don't understand what your post yesterday meant:
    they have been evicted from the big brother house!!
  • They are flying an effing kite if they think that as they are leaving without giving you any proper notice you should agree to not charge them any rent for the rest of the month. Don't give these two parasites a ruddy penny! It has been the coldest winter for 30 years and people's heating bills have gone through the roof. Who knows what bills may or may not have been run up until you get them? When you get the bills you will then be in a position to refund any monies but not before.

    They are lodgers, not tenants.

    "From 6 April 2007, when you pay a tenancy deposit for an assured shorthold tenancy to a private landlord or letting agent, the deposit must be protected by a government-approved scheme."

    It is a shame you could not have met them halfway. Taking in lodgers requires give and take on both sides, and throwing people in the streets is a hard thing to do. Much better to compromise and leave on good terms. I had more than one lodger ask to come back later. Did you really have reason to believe they would trash your house in the last month?

  • It's not about trashing the house. The rent fell due, they don't want to pay it as they wanted the OP to deduct it from the deposit. The deposit is held against future bills and should not be returned until all bills are in and shares calculated. Ergo, they are now living free without having paid any rent for the time since the last rent-payment. Therefore if they do not want to pay the rent due they must leave. Immediately and wait for their deposit monies.

    OP has them over a barrel as I doubt their new flat is available this evening for them to move into.

  • Not throwing them on the streets..it is their choice as paying no rent!!!! I asked them to pay at least half the rent..I thought I was being reasonable!! But they did not think so!!

    So compromise yes, i agree with, but being taking for a ride..no I do not agree with.

    Had reason to believe they would do something when they both squared up to me last night!!
  • It's horrible to be outnumbered in your own home. Please call some chums round to give you moral support if you can.
