Not sure how long you have been in this new DMP with them but it would be an idea to write a fairly strong but polite letter (send it recorded **or see below) explaining the fact that you have made no inroad in your debt even though you have complied with the agreement (you will need to supply proof of your payments) and therefore you cannot see the debt ever being settled. Politely ask for the charges to be frozen while you pay off the balance of the debt. If they are aware of your difficulties they are obliged to offer some constructive help.
I see you say you have requested a refund and also a stop to the charges. Have they responded to this yet? Perhaps an appointment to see the branch manager might be appropriate, you could always hand him/her your letter**. Stopping the increasing charges is the first priority I feel. Phone calls are not always of use in situations such as yours as you have found. You need things in writing and keep copies of it all for the future too.
I have proof of pay, emts and they said yet again they will freeze charges again. How long this will last for As they promise this then start again with it
Sent a strong letter stating that they do freeze interst then start charging adain etc. see how I get on . Need this just clearing as just not getting any were with it dispite paying every month.0 -

Hi
My situation is slightly different. A debit transaction came out of my account after the last time I checked (5pm) on the day I went overdrawn, the day before I received my salary.
My dispute is that I was physically unable to avoid the charge by putting money into the account. Would this be considered under Ombudsmen regulation does anyone know?
Also, how does the bank's new definition as an 'overdraft arrangement fee' rather than bank charge affect my case?0 -
Hi
I have recently reopened a claim complaint for unfair bank charges with HSBC. I have proceeded down the route of financial hardship with the position the charges have put me in etc etc
I received a letter back today asking me to complete a finances booklet and call their money management team, I did this and then they informed me that they cannot help with debts that relate to other company's, they can only assist with HSBC related debts.
I asked the person on the phone to raise a complaint explaining that the service they offered was no use to me and I was unhappy with the response.
The last line of the letter reads "I am looking into the matters you have aise and will contact you with a response as soon as I have completed my investigations"
Anyboday else in the same situation with HSBC and should I just be patient or send more letters0 -
Hi everyone.
I have a marine mortgage loan and I have asked the lender (Bank of Scotland) to move the payment collection date by 2 days to stop charges from them and my current account bank (Barclays) because the payment never goes through the on the 1st attempt. It goes through on the second attempt when they try and collect the payment direct debit a couple of days later which is when i have asked them to collect anyway. This has been going on for years and now it has pushed my overdraft beyond its limit so Barclays are hitting me with £90 a month for that as well. Both institutions are charging me £25 for the non payment of the 1st direct debit attempt AND another £25 a go for sending me a letter telling me this. My question - I know iI can reclaim the charges from Barclays but can I also reclaim these charges from the Bank of Scotland for a marine loan (unregulated)? Any advice would be great. Thanks in advance.0 -
Anyone had any success in getting their bank to do a quick reversal of a bank charge? The bank has just charged me £125 for exceeding my overdraft by £200. The trouble is, they took it out the day before my rent is due. So now the rent will either bounce or I'll exceed the overdraft again. I've already told them that I'm in financial difficulties due to illness. I really need the £125 now to pay for food and rent. I was hoping that if I went back to them and explain my situation (again) they might take pity and reverse the charge:rotfl:
If I go down the process of complaining and the ombudsman its obviously going to take time - which is the issue for me. It might also be better for them as if I had to do that I'm then more likely to claim for past charges.0 -
Hello,
I'm relatively new to the site and have just telephoned Barclaycard to ask for a copy for credit card statements and was told it was £3 cost for each monthly copy statement (£216 for 6 years!!) Was anyone else told this? Is there another way I can find out how much I have paid in charges and over limit fees without paying this much?
Any responses will be appreciated
thanks

You need to adapt the data protection request template letter on here (scroll up to find it) to get all your information. This should include charges, historical stuff and usually statements too. The cost is normally £10 for the lot although some folk seem to have got their info for free. Ask in your letter about the charge or send £10 cheque with your request to speed things up if you want.0 -
Hello would be greatful if one of you could look at this letter and let me know what my chances maybe of recliaming these charges??? i sent the below letter, copies of the higlighted charges on my statemnts and monthly expendidure sheet including all bils and debts.
Barclays Bank
Dear Sir or Madam,
Ref: Account number: XXXXXXXXXX
I am writing to request that you repay all the charges in relation to direct debits, unauthorised overdrafts and standing orders that have been applied to my account in the past six years.
I believe the fact that I have been incurring bank charges goes contrary to the aims of the Lending Code (Section 9) and Banking Conduct of Business Sourcebook (section 5.1.4 ‘in particular, a firm should deal fairly with a banking customer whom it has reason to believe is in financial difficulty’). My personal situation has been affected by the charges leaving me in financial hardship and I am writing to request that you take the following grounds into consideration:
I lost my job as an Site sectary in 2008 and my partner also became made redundant the year after, due to these issues times became tough. Soon we were unable to pay the bills and moved into our overdrafts and beyond it with both accounts we have and a joint account. We then started to be hit by charges of £30 a time, which were completely unaffordable and we were trapped unable to pay them back with out getting out of the cycle we were in regarding money, even to the point where I had to contact Barclays to up my personal loan to pay my bills. My partner is still unemployed and claims job seekers allowances making all bill payments very hard to keep up with, these include getting behind and in arrears with our rent, council tax, water gas and electric. Due to this I have recently had to contact you (Barclays) to seek advice regarding my personal loan explaining that I can not afford the monthly payments and can not afford anymore charges regarding my account. Due to this Barclays gave me a resolve loan stretching the payments over 10 years to witch I am still struggling to pay.
We have both also joined debt management plans to be financial difficulties.
As you can see below are just a few issues I have and would be very grateful in the return of the monies.
· Can’t pay for necessities - struggling to meet basic necessities e.g. rent, council tax, food, utility bills, debt, often resulting in high arrears
· Can’t pay debts - struggling to make loan and credit card repayments even when in a debt management plans
· Payments regularly returned - payments regularly get returned unpaid as not enough money in our accounts
· Substantial drop in income - For example partner has become jobless claiming job seekers allowance since 2009 and myself contracting my work load unable to obtain a permanent job.
· Going into debt management - Getting a debt management plan including Barclays resolve loan
· Living off credit. Regularly asking creditors to increase my credit limit or to obtain new credit, always resulting in the answer ‘no’
· Regular credit card cash withdrawals. using regular cash withdrawals from credit cards to make ends meet, including high interest pay day loans.
· The charges are disproportionate. Unintentionally slipping over my limit by a few pounds and the charge is a lot higher than the ‘offence’ e.g. going £1 over but been charged £30.
· Were stuck in a cycle of charges.
The charges total £1100.00 and I ask that you repay me the full amount.
Plus as I believe I have been unfairly deprived of the money I have calculated £377.55 interest at the statutory rate, the amount a court would award and I ask that this be added to my claim to give a total of £1461.55
I have attached a full schedule of the charges with this document and also my monthly expenditure.
I look forward to a full response to this letter within 14 days and if I do not receive a satisfactory response I intend to pursue my complaint to the Financial Ombudsman Service or small claims court at the earliest opportunity.
I look forward to your response.

Hi all,
I;ve just been going over my online bank statements from a few years ago (2005-2006 to be exact) gathering info for a potential PPI claim.
I realised that back then i was in quite a bit of a financial pickle and getting charges for bounced cheques and unpaid direct debits left right and center.
It even got to the point where i have a payment on my statement to a debt collection agency (i forgot it got that bad!)
Anyway, The story today is quite different. I have a pretty good income, a mortgage, etc etc
I'm wondering if i would still be able to reclaim those bank charges from all that time ago. i've read on here that it's mainly for people in financial hardship?
I no longer use the account in question anymore but it does still have a £1800 overdraft still outstanding, so my thoughts were that i could submit a claim and tell them any money refunded can be used to repay the overdraft?
Any advice?0
