HI not sure if anyone can help, I got a letter sometime ago from a solicitor asking me to complete the notice of discontiunance, if i sign this will i be liable for any charges? .... I was reclaiming Bank charges against HSBC0

I have been on a DMP with the credit consumer council for three years and most of my debt is going down apart from the TSB bank account I orignally became over drawn with around £2.50-£1.50 and had £90 charges for daily usage fee. I got these charges refunded then ended up with more charges on top of this and on it went, I decided to try and do a dept mangement plan my self The TSB would change the dates I had agreed too or they would give me a date to pay the amount then said the money had to go into the account 4 days before the due date even if payed in the bank. So the stress was too much for me and I went for a DMP still had lots of problems with TSB say they not recived the money which had been sent failing the agreement then ask to stop the charges and then would for a while then start again. Last month they chagred me £90 daily unplanned over draft, £17.50 interest and £5 usage fee. My debt is no less than when I first started the dmp and called the call centre in another country who say there not dealing with it tried the one they gave me and no there not dealing with . very stressed by the whole situation Wrote for a refund and stop charges. need help:mad:0

My main concern here is that the bank claim they haven't received your payments. Not sure how long you have been in this new DMP with them but it would be an idea to write a fairly strong but polite letter (send it recorded **or see below) explaining the fact that you have made no inroad in your debt even though you have complied with the agreement (you will need to supply proof of your payments) and therefore you cannot see the debt ever being settled. Politely ask for the charges to be frozen while you pay off the balance of the debt. If they are aware of your difficulties they are obliged to offer some constructive help.
I see you say you have requested a refund and also a stop to the charges. Have they responded to this yet? Perhaps an appointment to see the branch manager might be appropriate, you could always hand him/her your letter**. Stopping the increasing charges is the first priority I feel. Phone calls are not always of use in situations such as yours as you have found. You need things in writing and keep copies of it all for the future too.0 -
Hi Guys,
Nearly hit the roof earlier when I check my account online and noticed that the Bank (RBS) has charged me again (thats now £54 in the last 30 days) Charges keep appearing at the end of the month out of the blue and they are making me overdrawn thus creating a charge again the next month. This has happened at least the last 3 and 4 months and is beginning to !!!! me off.
I stumbled on the guide here and decided to look at my accounts over the last 5 years (as the guide states for Scotland) and I am truly horrified at the amount of times I have been charged, one time £35 for being overdrawn 22p (this was also because of a bank charge the previous month)
So after studying the guide I reckon I don't qualify for hardship but I do qualify for reasons 2 & 3 (Over charging & snowballing)
I am going through my account just now for the last 5 years and I am noting every charge and the reason for it. This should give me some ammo to at least make a start and phone the bank.
What do you guys think my chances are? I at least want the last two months charges back as they are just ridiculous if not I will be telling them I am moving my account.0 -
Just a quick update as per my post above, as I have gone through my account since may 07 I have found £300.95 worth of charges all with the exception of one which was due to a D/D coming off on the wrong date. Also all seem to be incurred by the bank placing charges the previous month. One example was they charged me £28 for going over 22p the month before which was because they charged me £34 the previous month.
Absolutely raging at the minute. Not sure its my fault entirely as most of the charges are results of charges the month previous.
Anyway I still have 2010 to go through and 2011 as well.0 -
Ok reckon the bank have taken £557.95 off me in the last five years and all bar once has been charges upon charges each month. Charging me and then overdrawing my account creating another charge the following month.
I might be on to nothing but I will phone today and then see what response I get if its not what I am after then I will write them a letter detailing what I think I am owed and I will take it further after that.0 -
