    I know this may sound a little silly but i have had an account with hsbc and just looking through some old statements ive discovered i paid in 1 year over £800 in charges for going over my overdraft bearing in mind i only worked 10 hours a week some of these charges took nearly all of my wages. I have rang hsbc and they have told me there is no point in asking for the money back as the court case is now over and the bank do not have to pay out. Just would like some advice as to weather i should still claim?

    It's not a case of should you, more of could you claim.

  • Hi i have disturbingly read the above post that as my debt has been passed on to a debt recovery agency i will not be able to claim back my charges.
    I bank used Natwest and have had around £2500.00 in charges over the last 4/5 years, the reason the account got passed over was due to me not being able to afford to pay back, surely that makes a strong case for financial hardship? I would gladly have the money set against the money i owe them would this be possible? If i contacted them by phone and said look im going down the route of reclaiming my bank charges and thats £2500 but i owe you £1600 can we just wipe the slate, or should i follow the template first and not phone them?? Any advice help would be greatly appreciated.

    Hi,
    Regarding bank charges. Can I claim from 2012 back to 2006 (6yrs in total) or is it 6 yrs back from 2006?

  • Hi, could you advise me please. I've recently come across a load of mini statements for a joint Halifax account myself and my hubby had. They have fee's on them some as much as £96. They are dated 1998, 1999, 2000. I'm not sure when the account was opened and I'm sure we walked away from it probably leaving an outstanding balance of mounted up fee's. Can I do anything with this regarding claiming back the fee's please.

    You can't claim back what you haven't paid. Halifax don't usually settle complaints of more than 6 years ago anyway.

    If you do owe them money, as soon as you put in your claim, a Debt Collecting Agency will pounce demanding repayment of the debt - sold to them by Halifax!! All they need is your address (which will be supplied by ..... Halifax).

    If your debt is less than the charges you have paid there is absolutely nothing to lose by contacting Nat West with your 'proposition' providing you fit the financial hardship criteria.

    I wouldn't phone personally. You need to write to them with all the detail that is relevent to your case. ie: why you were unable to repay all of the debt. Be humble and honest. Just not being able to pay your debts is not enough, you need reasons, good ones.

    For example: You found it difficult to pay your rent or were behind with mortgage. Difficulty paying living costs, gas, leccie etc. Not much for food. Other debts were mounting up.
    Any illness needing extra funding. You get the picture?
    Study the MSE site for all the useful info. regarding the hardship including the Financial Ombudsman Criteria.
    Don't mention unfair charges in your letter.
    You need a very strong case of financial hardship to even be considered. Put to them that you feel it reasonable to offset part of the refund to clear your debt with dca. Your case will be re-enforced if you are actually in the process of paying off the debt with the dca as this shows you are trying to get things sorted.

    There are no guarantees you will be successful but it may be worth having go. Good luck

    I was just wondering if anyone has had any success with their claim after going through to the FOS? After reading lots of posts, it seems most people are settling with the banks rather than going on to the Ombudsman.

    I'm in the process of reclaiming £7500 of charges, on hardship grounds.
    I got a letter back from my bank (Santander) on 2nd May rejecting my claim saying I wasn't in hardship, not in a cycle of charges and that my account shows "instances of NON-ESSENTIAL SPENDING" !!! (BLOODY CHEEK!!!)

    I phoned the bank, again, today to query their response and give them more detail on my situation. The lady I spoke to seemed quite helpful and after reading (on her screen) my letter and the response I had been given, she decided that she would refer my case to their Hardship dept. She took my mobile number and told me to expect a call within 48 hrs.

    Now while I know the chances of them offering me back the full amount, is slim to none, my financial situation is so bad that anything less than half won't really help get me back on track.
    I'm trying to figure out my options before I get the call as I feel they may make me an offer, but do not know whether I should accept an offer try to stick it out and go on to the FOS.

    any advice?

    Hi - just a quick question as I can't see it covered anywhere. I'm considering claiming back my charges from a bank current account - but the I think the bank is also my mortgage provider. By reclaiming my charges would this put me at risk of them "pulling" my mortgage?
    Prov1 £3392 - Aqua £1136 Vanquis £1500, HM £21, Barclays £680 Payday Loans - £1000 Mother - £770

    Total debt exc mortgage - [STRIKE]£11857[/STRIKE]] £10092.37 . :wall: Savings Pot - £22.50. :o

    Hi, Can anyone help?

    I sent a letter to Santander for reclaiming bank charges under financial hardship totalling £2034.55 inc interest. I haven't had any reply from them but on checking my account yesterday they have refunded the last 2 months of charges £114.50 - no interest included. I am confused as my claim goes back to charges from 2009 yet they have only refunded these 2 months and with no communication?? what should I do now, if I just keep waiting for a letter does it look like I have just accepted this refund...I am confused..
