Report Bank Charges successes and failures

  • Hi, is there any success story's with natwest paying out bank charges, I looked last nite and mine is about just under 2 grand, is it worth me doing it. Xx:j

    Hi, we recalimed from HSBC successfully about 5-6 years ago and got about £3,500 back.

    Ultimately we were in financial hardship at the time and the charges kept coming and they've probably had the whole amount back.

    At the time we owed a full years council tax, and became 5 months behind on our mortgage at one point. We also had 4 credit cards, a loan and my husband lost his job in August 2008.

    Did HSBC set a precedent in the fact that they already repaid us once, and that as we were in financial hardship all that happened was they pretty much ended up with all the money back again.

    Is it worth trying to claim again on this basis?

    Incidentally we now havent had any charges for about 18 months, so proof to them that we have now turned a corner, but back when we needed some help they were charging us £25 a pop.

    It's impossible to give you an answer based on the absence of detail other than <2k of charges.

    Suggest you look here and see if you might qualify for severe financial hardship criteria as a basis for your claim.

    If you have already successfully received a refund I don't think
    you will have any joy trying to claim again, I have read somewhere that this is the case.

    Also you mentioned you are no longer financially struggling, therefore you would have no basis for a claim.

    I know that was the case with the standard claims, and at one point banks were payingout second claims but closing the accounts after, but having read the info on qualifying for financial hardship you have to be able to prove that you are in hardship now, or were at the time the charges were being applied, which we were. Is this not the case then?

    Yes you are quite right, you do have to give proof which you gave and, as a result, were successful with your refund claim.
    I wouldn't have thought they would refund twice under the same set of circumstances however, perhaps you may base your new claim on hubby's loss of job etc?

    Sorry I don't mean to sound negative but there is nothing to stop you making another claim if you think you might be eligible for consideration.

    Hi, our original claim was made at end of 2006, we didnt provide any evidence, we just did it when everyone was entitled to claim a refund, so pre the Court decision re fairness. We received a refund in Jan 2007 of some of our fees, £2,500. From February 2007 to end of 2009 we then paid HSBC a further £3,800 in charges. So what I'm saying is the original claim was for one period of time under the original rules of claiming, I would have claimed sooner had I realised that our circumstances in 2007 onwards meant we could apply under hardship rules.

    We have all the paperwork we had to submit to Abbey with regard to the mortgage arrears which showed our income lower than our outgoings. We also received a hardship grant from our water supplier during this time.

    Well anyway for the sake of a letter I'll apply. Nothing ventured nothing gained.

    The Supreme Court ruled that bank account charges were fair in 2009 and that only hardship cases would be considered for refunds.

    Hey, based on the info. in your last post it would seem you may have a good case after all, especially as you say, it's a later timescale. You have all your amunition to evidence your claim which is excellent.

  • hi all appreciate any help in advance

    i wrote to barclays for the information as per the template but have heard nothing as of yet

    is it worth my while still writing asking for charges back without information as to how much they are?

    how do i report the fact they have not provided the information i asked for? have rung them with no joy

    I had loads of trouble getting my info from Barclays, but kept ringing every other day and asking for managers.

    I was then sent a schedule of PPI (which is not what I asked for) so I called back to complain yet again - I then got through to a Customer Relations manager called Tracey Liburd who was a great help and got everything sorted for me.

    I then received copies of every statement for the last 6 years, which again is not what I asked for but still helped. I sent off a claim letter last Thursday, and am waiting for their response.
