They are both 'technically' right I'm afraid. You can only base a claim on financial hardship since the court ruling. Or perhaps clerical error if the bank genuinely made mistakes etc.
You would have no luck by taking the next step which would be going to court because the law has stated that the charges are not unfair0 -

my wife complained to the Ulster bank in January 2012 about bank charges and fees on a personal and business accounts we had with them. 5 months later they offer her £550 which we refused. they had taken close to £4700 out from 2007 in both accounts. So it looks like its the FOS turn to see what we can do0

Hi.After reading and and following everyones tips and advice on this site.I have decided to give it a go and try and reclaim over £4000 in charges from RBS..I went down the harship route, after suffer severe financial troubles. I received 5 usual standard (YOU GOT NO CHANCE) replies. This week I have received the final ( LAUGHS OUT LOUD LETTER) which was different from the other 5.This also states that the charges were lawful and that they do not intend to refund anything.I have written to the Ombudsman, and Im wondering if anyone has had any luck at this stage.Or should I just go straight to court.What are my chances.? I have this morning wrote to the complaints at Santander, as they are the new owners of RBS, asking also if they would look into my claim.
Any other advice would be welcome..

Hey guys, I wrote my own letter of complaint back in september to Llloyds TSB, only took 2 weeks for them to write back to let me know the money was in my acount, £1995 worth of charges back. I did claim under the hardship rule though as the charges were taking me further and further into an unplanned overdraft that I couldnt afford to pay back.
There is light at the end of the tunnel. No loss to just go for it! :T
Im now writing to claim back PPI on a loan I took with them as that was also done unfairly. Just a little advice.... Ive had no end of trouble with Lloyds, partly because im not understood by whoever it is I'm talking too and wrongly been given advice etc. Choose another bank!

Did you get a reply? I did this with Lloyds last year under the hardship rule, which looks like it may apply to you too. I got nearly £2000 back within the space of 2 weeksHope you get this sorted! x

i wrote to barclays for the information as per the template but have heard nothing as of yet
is it worth my while still writing asking for charges back without information as to how much they are?
how do i report the fact they have not provided the information i asked for? have rung them with no joy

right i sent a letter this morning anyway despite not having the information
got charged another £105 today
