OK so happiness short lived..:mad:. i had claimed for over £5000 (charges plus interest) i today received aletter saying what they have already paid £315 is all they will pay:(, i have just emailed back asking them to consider a final payment of £3000 as this will clear the overdraft and payday loans which were taken out to cover the deficit left by the charges, else i will take my case to the FO. all i want is an end to the spiral of charges:o

Well Wigglespig, after I agreed to the guy on the phone putting a stop on all loan payments and crediting my account with £661.30, I checked my account tonight and they have taken a loan payment and another charge! I have emailed the CEO's office yet again informing them of this and asking them to contact me. I am fuming - especially as the guy woke me up.
A good friend works for a local and very reputable Financial advice company / Insurance brokers and she has advised me to inform them that I am going to now go to the FSA as I shouldn't have been 'sold' (ie: forced to take out) the loan in the first place. The guy is such a whizz kid with figures (working in the CEO's office) that he has also miscalculated how much of the loan I should get back too......

To add my first letter was sent to the CEO of Lloydstsb using the standard template from this site + a summation of all the charges I had incurred dating back 6 years on 13th August, 24th August payment was credited on my account and on 26th August (today) I have had confirmation from Lloyds this was due to my request :j
I honestly did not think I would get any money back but very glad I put the hour of effort into personalising the email and reviewing my statesments on line, not bad for the cost of a stamp!

I applied to HSBC in 2009 to refund my bank charges but got a no! As the new ruling then came in I didnt do anything further about it.
Now we are in serious financial hardship to the point where we have debts with HSBC and they have closed our account and referred our debts to a collection agency. They are aware of our problems.
After reading Martins advise I would like to try again.
Should I start a new claim or chase up the existing one 2 years ago? As they have closed our account I cant remember if there have been any further charges or if they put a hold on them. I notice some people have been lucky enough that the bank have picked up on charges they have missed. Should I write with the charges I know about or am I being niave and should get a comprehensive list together first?

Hi, first time poster on this particular section and I am wondering could I claim back charges from my bank. It's The Northern Bank (N. Ireland). I currently have a 2k overdraft with them which i pay around £14 - £17 per month for the privilage. Unfortunately sometimes I go over the 2k and each time I am charged £25 for doing so. The max amount they can charge is £75 per month, most months I am paying anything from £25 to £75 plus the £14 -£17.
Can they do this?
I am a bit afraid of complaining in cast they would close my account.0 -

Yes, if the charges are in lines with the terms (which they appear to be based on what you say) then they can certainly charge them.
Wit regards to reclaiming, have a read of the article. Essentially it would only be the £25 charges that are reclaimable, but there is no obligation on a bank to refund any charges correctly applied. Unless you are in financial hardship, then the chances of success are extremely limited. Even if you are in financial hardship, you will need to demonstrate that this was a recent event that caused you to have a reduced disposable income, that you have priority debts and that the charges applied made that situation worse.
If you are living within your overdraft (which you appear to be doing) then speak with your bank to see if they can offer a cheaper method of borrowing. Overdrafts are great for what they are intended for (borrowing a small amount of money at the end of a particularly tight month) but living long term within them is very expensive; there are better solutions for long term borrowing."Now to trolling as a concept. .... Wrote to HSBC recently requesting back £1906.00 in bank charges, and with interest £2263.15.
Had a letter back within about a week saying they are 'looking into it', that was about two weeks ago, and I've heard nothing since. Checked my accounts with them just now and there is a credit on there called 'refund of charges' for £100. I'll wait and see if they send me a letter to explain what they're up to, but £100 offered when they charged me £1906 and put me in severe financial hardship?! How can that be fair?

When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.

A sweet victory - hooray.
I had no idea I could claim back 7 years so I tried to see how much PPI I had paid I Sent off the standard letter at the end of May to RBS and FSA and got a nice letter offering me in total (including interest) £3600 inc interest, shame they cant pay it up straight the way but after 7 years a week or two wont matter... I have actually booked a well deserved holiday
