    Devastated ..complained first to Nationwide then Ajudicator (at the ombudsman) and finally an Obudsman on the grounds of financial hardship.
    N/wide said I had enough money coming in to cover my outgoings (I proved I didn't with account statements and a financial statement compiled by the Citizens Advice Bureau) - I also paid off a £2,000 overdraft with them during this time.
    After direct debits started to bounce and I would go overdrawn I asked them to let me have a £50 overdraft to avoid charges that were crippling and leaving me with even less money the following month.
    They refused, refunded one month of charges as a "gesture of goodwill".
    I had a Stroke last year, contacted the ombudsman to tell them of my ongoing financial problems and serious health issues. They said they only received one letter and no-one seemed to know why this had not speeded up my case.
    Amazingly the o.man decided n.wide had "acted fairly".. The charges I tried to claim were in excess of£3,000 plus interest.

    According to your earlier thread here, you claimed to be receiving "DLA,Child Tax Credit, Child Benefit and Incapacity Benefit" and have "been on it for 17 years with an ongoing deteriorating condition"

    What caused your sudden and unexpected drop in disposable income last year, and yet still be able to pay back over £2k of debt?

    I paid back the overdraft over 3 years ago.
    One child left full time education.
    The rise in the cost of living..

    Whilst a refund of charges is never guaranteed, where they are refunded, it rarely covers charges incurred more than 6 months ago ;)

    So you are no longer financially responsible for that person :)

    If that was the basis of your claim for financial hardship, then I would have to agree with the initial findings of the Nationwide and their concurrence by the FOS ;)

    No that wasn't the basis for my claim with n/wide...

    of course I should have stopped feeding my child and told her to leave home the day she turned 18 and walked into a well paid full time job !

    Clearly from other posts on this thread some banks do pay back charges going back much longer than 6 months..

    Would you go and pick through someone elses post ?

    Hi all,

    I hope you guys can help me.
    I have an account with Halifax and have a planned overdraft of £600, I get paid on a weekly basis and work for minimum wage and struggle every week to pay bills etc and most weeks go over my overdraft limit.
    I have not been in the black on this account for as long as I can remember, I have asked for a small personal loan just to clear the overdraft which has been refused multiple times.
    So after reading this I have learned this is called snowballing, without fail every month I get charged upwards of £50, often a lot more.
    Am I in a position to try and claim back anything?
    I really do struggle every week to pay all of my bills.

    Hello all, have not posted for some time.
    How rigid is the 6 year limit? I ask because I have 3 cards with charges between 2000 and 2006, quite substantial.
    Is it still worth a try?
    They are with Cap 1, Yorkshire Bank and HFC.

    There is no 6 year limit. It is the period that firms usually use to start destroying old data and typically that means they only keep the last 6 years statements. It is not a rule.

  • I sent an email of complaint online to RBS stating that I had charges on top of charges for a few years now and was reclaiming £300, received a phone call the next day to offer me £120 goodwill gesture and my £40 charge for this month wiped. Even though its not the full amount I requested I was still delighted and shocked to even receive anything never mind £120! Would never have even thought bout doing it if i hadn't came across this article THANK YOU!
  • I have recently wrote to Lloyds TSB claiming 1500£ in charges and 500£ of account Fees. Got a letter saying No refunds for me.

    So gone to obudsmen about them. Have also claimed from Mint, capital One,natwest and Barclays still waiting to hear back from them all.

    Reading your updated posts as made me feel a bit more confident though
