The point is that he only needs to declare it if it was an arrest or conviction for a crime involving moral turpitude or if the arrest was drug-related.

The US Governent site and the US Embassy site differ greatly in their definitions and I would guess that the US Government should know the rules...

See these links for detail -

    US Site

    US Embassy Site

    Specifically -

    HERE

    HERE

HERE (see '(2) Criminal and related grounds')

Of course, I'm no lawyer, but it seems pretty clear to me that the US Embassy in London are playing it very safe (but then that is probably the sensible thing to do)

EDIT - Just found some definitions of Moral Turpitude HERE

Yep, Airtrain ($5 I think) plus Subway (I think $2 or use an unlimited ride MetroCard which will be useful at other times during your stay) is cheapest, but quite slow (1 hour plus?)

Perfectly safe (at least in daylight hours) but not quite as easy as a taxi...

Chez I think you are getting a bit confused and confusing others

You do not qualify for the Visa Waiver scheme if you have any kind of conviction. This is stated quite clearly.

If you have any sort of conviction even if it is spent you will have to apply for a visa. You may not qualify for a visa if you have convictions related to drugs offences or convictions related to Moral Turpitude

As I said, I am no lawyer, just providing links which others may find useful to make their own mind up..

One final link, here is the official guidance and a copy of the VWP form -

I'm sure that the people who get turned back have ticked the yes box and drawn attention to themselves this way, maybe they thought it wouldn't matter as it was a long time ago and/or a petty offence. Well it does matter so NO it must be and you will be fine.
I now have a visa but travelled many times before without one, when I should have had one, with no problems.

The questions are a bit dumb really, do they really expect potential terrorists and the like to tick "Yes" ?

Hey guys, I've been doing some research on the cost of NYC accomodation, and.... Wow! Anyhoo, here's a tip which might help some travellers wanting good quality digs for excellent bargain budget prices, although someone else on this thread has recommended against what I'm about to suggest...

New York is one of the Greatest cities in the World and I know you'll have a good time, And whatever you do STAY IN MANHATTEN, I made the mistake of staying in an Airport hotel when I was there on a Business trip once and the commute from the hotel ( or anywhere outside of Manhatten ) is a nightmare, especially if they're doing Repair work on one of the Expressways.[/quote]
...but, using priceline (for example), I have found a few 3* hotels (with pool, fitness centre, restaurant & airport shuttle) situated at Newark Airport (rather than JFK which is approx 22 miles away) for only $55 to $84 per room per night!!

Taking the lowest price of $55 (£30) x 6 nights = $330 using todays conversion rates = £180 approx, with maybe another £20 for taxes and hidden extras = £200/2 people staying in the room = £100 each!!! Add that to your bargain return flights of £150 and essentially you can make this trip real budget style for £250 each return for 6 nights and 7 days in the big apple!!! :j

As a dedicated MSE'r, I shudder  and refuse to spend more on the accomodation than the flight, and of course this option is not going to suit everyone, but I just thought I'd let you all know that you could do it this way.....

    Hope this helps.
