  • I still have no PAC (after waiting 15 days)...

    ...so I phoned up Ofcom. Turns out that Fresh should have provided it in two working days. I heartily recommend contacting Ofcom (0300 123 3333 or 020 7981 3040) if you've suffered as a result of Fresh closing. They're quite friendly and I suspect the more of us that contact Ofcom, the more influence we'll carry.

    I still have no money...

    ...despite Fresh agreeing to refund it to me by cheque. Now they're saying it says in the Terms & Conditions (T&C) that they're entitled to keeping my money. So I contacted Consumer Direct, a government funded legal advise center, who suggested that I ask Fresh to clarify where in the T&C it states this. They got back to me today, but didn't clarify. So I've asked them again.

    But they did provide an example of how my credit would be transferred to my TalkMobile SIM, had I requested one...

    "For example, if you receive 5.00 credit on your Talkmobile sim card and you had 6.52 credit left on your Fresh account then by 15th April 1.52 credit will be transferred to your Talkmobile account. Totaling 6.52 credit you would have received altogether. "

    So I started with 6.52, and I ended with 6.52. There's no £5 extra that I can see. Neither do they say that my old mobile (locked to Fresh, say) will stop working & I'll have to buy a new one. All of which looks like misrepresentation to me, so I'm just wondering about complaining to the advertising standards agency.

    1. Getting credit back from CPW...

    I would run my credit down to almost zero, and give up on the pennies that are left. I suspect that if you run it into the red CPW wouldn't hesitate to put a black mark on your credit report. If there's a better way then I'd be interested in hearing it, though.

    2. Buying a cheap phone & going elsewhere

    It all depends on whether it's locked to a network. I don't have experience of this, so I'll leave it to someone wiser than me to comment.


    But your real problem could get getting a PAC so that you can port the number away from CPW. If you don't need to do this, then there's no problem. But if you do then be prepared for a long process (as I noted in my other post today, I've contacted Ofcom because I've had to wait 15 days so far - Ofcom tell me I should have it within two working days).

    If I buy a phone with a Tesco or Asda payg - fifteen quid phone nothing more - will I be able to use the sim CPW supplied to run down the credit there before using Tesco/ Asda full time?

    (May be no surprise to anyone, but this whole mobile phone as £50/month fashion/lifestyle accessory has really passed me by)

    Ok I'll answer my own question :)

    CPW sold me a Samsung E1100 for £14 that came with a Virgin sim with a £10 credit and 200 free texts to use in the first month (I might use 10 of them).

    Once I've got through the Virgin tenner I can put in the CPW sim that they sent me when I moved from Fresh and run down my own credit there. I can then put an Asda sim in the Samsung E1100 when I 'port' my number from CPW

    I did read that there are over a million mobile phone tarriff combinations available in the UK and I sincerely hope I can go the rest of my life without ever having to look at another one. For all the segmental/lifestyle BS they give you about these tarriffs, it's just a racket to make it difficult to compare prices across networks.

    Come on OFT get further tore into this industry.
  • Ok, so technically, are all the people who have credit on their phones not creditors of Fresh? Is it possible to apply to put them into liquidation? Wouldn't do the brand reputation of CPW any good! Just a thought...
