I have been on Incapacity Benefit since October 2006

Now it appears that because they changed the name to ESA (employment based) I don't qualify for the Cold Weather payment, even though when I started Incapacity Benefit it was due to my NIC being up to date.

So just because they changed the name and I am still called by the old name I can't have the payment

I also have DLA Higher Rate of Mobility (as a vehicle) and Lower Rate of Care
Er no you are not entitled to a CWP on incapacity benefit.
    *SIGH*

Have you checked that you are definitely entitled? A state pension alone does not qualify you for CWP's.
    Gone ... or have I?

it depends when it was triggered as to when its paid out, my last was triggered on the 4th its going into the bank on the 13th to give you some sort of idea of timescales.
  • Just spoken to a gentleman who was very lovely in the Hull BDC. He says that they're automatically picked up and you should recieve payments WITHIN 2 weeks of the trigger. If you have not had the payments after 2 weeks (My second was triggered on the 4th) then give them a ring and they do a 'scan' to pick out those who weren't automatically picked up.
  • I am keeping my fingers crossed this is the best place to post my question as just spent a couple of hours being passed around the benefits phone systems with no luck.

Last week I was awarded ESA income based, backdated fourteen weeks, and I will be in the support group now. This morning I have received an award letter for DLA, middle rate care and lower rate mobility both payable from November 09.

My question is whether I am entitled to the cold weather payment my area is getting? The key seems to be a severe disability premium, but I just cannot fathom whether I qualify for that, how to claim it etc. Online the info is hazy, not clear whether the SDP element is payable only for IS claimants or ESA claimants under the new rules?

I hope this makes sense to someone and I can find the answer. Any help gratefully received.
But there are dreams that cannot be,and there are storms we cannot weather!

    Hi There

I have just phoned the DSS and they are telling that even though the gov.com postcode checker says my postcode has had two triggers it doesnt mean we will get payments. Then he said it is a game of catch up, and that they need confirmation from the met office themselves as the gov.com site is nothing to do with them. Am I right in smelling arat here? Like many people, not enough electric to run heaters anymore and cant buy any more coal, so what are we to do if what they are saying is right????

    Any help appreciated

sounds like whoever you spoke to is clueless if you want the simple answer, this how it works, your local weather station informs them so if its a trigger date theyve had confirmation, they imput that date into the postcode checker for people like us on this thread to see, once a weather station informs them they get the computers to scan the list of benefit claimants to see who is eligable, they then get sent out automatically although some on here seem to have been missed from the list. the dwp website is run by dwp it just goes under the name off direct.gov. if its been triggered and you qualify then you should get the payments, they are behind already i can tell you as my last one triggered on the 4th, when i rang this morning they said it would go in the bank on the 13th jan.
