LL wants us to put £1000 of CH oil in tank before move out

    As both Clutton and I have said. They are working for the LL NOT you. IMHO they have prob shot themselves in the foot by telling the LL they will get you to stump up something from your earlier chats. Now they have egg on their face.

    As for detrimental not to make an offer of some description....

    You offered to end your tenancy early to accomodate your LL's early return.

    You have cleaned the house and left better than when you went in.

    Tell them your "offer" is that if they aren't happy with any aspect of the tenancy and its ending that you are happy for it to go to arbitration.

    Also ask them can they put it in writing that it is detrimental for you not to make an offer, I gues they will go silent at this point.

    The TDS is there exactly for these cases, to protect genuine tenants from useless LL's. Honestly, stick to your guns. Oh and just so you know I'm not a LL hater, I am one myself, but I do things fairly:D

    stick to your guns... in fact, stop having conversations with them from NOW. just contact the Deposit scheme, register a dispute and have no further contact with LA... let the arbiters decide... LL WILL lose... this is definitely a con.... i hate landlords like this ..... they give us all a bad name

    in the evidence you finally present i would definitely include the leak.. as that has been a source of "stolen" money also.. you have been buying fuel, some of it has leaked away... he should be reimbursing you !!

    Arbiters will decide on the written evidence put before them.. get as much independent verifications for your side things as possible...

    We feel as has been pointed out, that we bent over backwarrds to accomodate LL..also bearing in mind we aranged to move out when I am 6 months pregnant and have other children to..we could have stuck to our guns and stayed until May.

    We will offer nothing and go to arbitration!

    great decision !! at arbitration is up to the LL to prove that you owe him money, not the other way round. LL will be invited to present his evidence, and you will be sent a copy ... let us know what exactly he is claiming when you get it....

    Absolutely 100% agree that you should stop all correspondence with the EA and the LL.

    It is now the point to go to arbitration at the TDS. Your LL sounds like a horrid person.

    As a seperate note, once this is all ended it might be worth reporting him to HMRC. You can do this anonymously. He strikes me as the sort of individual who might not be paying their taxes on this.

    Idly speculating here having had the previous owner of my house attempt to shaft me over oil left in the tank, and receiving excellent support & advice here.

    Suppose you DID get the oil tank topped up with 500 litres, took a photo of it as advocated above, copied the receipt & delivery note etc THEN quietly removed the oil to your lovely new dwelling. Not sure how you would do this as our oil tank is one of DH's jobs but it must be possible. If nothing else, you would literally & morally have a warm inner glow. ;)

    Good, I'm glad you got there in the end. Arbitration is there precisely for this reason and you don't want to be playing games with shady people.

    You will be very likely to not have to pay anything, as there is no independent evidence. DPS might decide on to share liability if there is some scratchy evidence, but it's better than messing around with 'offers'.

    If you want to play dirty then remember that oil floats on water;).

    You don't need to do anything than play by the book you are in the right, a fact that they will eventually learn.
