LL wants us to put £1000 of CH oil in tank before move out

    i think we have to assume that the LL will lie... but until he presents the evidence and we hear back from OP its pointless speculating...


    even if he does lie... he cannot prove the level of oil on day one of the tenancy and that OP signed and agreed that level.. - as far as i am concerned that is the only fact that arbiters will be interested in .....

    we had a similar thing with gas, the tank was full when tenant moved in empty when they moved out we requested the money from the deposit.. they disputed it the TDS found in favour of tenant as we had no proof it was full when they moved in. Nothing mentioned on the inventory deposit returned in full.

    As for reporting him to the tax office though, the guy lived abroad.. i presume the rent was paid to the agent? The agent would have to tax the tax off him unless he had a approval number for the NRL scheme. so more than likely he either did not have to pay any tax or the agency paid it before sending on the rest to the LL.

    yeah, if they guy didn't have an agent then don't go anywhere near tax issues. It is then responsibility of the tenant to deduct tax (stupid system in my opinion).

  • Well we have completed checkout..the LA commented and how spotless the house was and LL himself said that he couldnt beleive how immaculate the house was, they could move straight in.

    He then insisted that the oil level in the tank was dipped..despite it having not been done before we moved in and saw that the oil had almost gone...he then told my husband that he had 2500 litres put in in Sep 2008 which he had written evidence of..and therefore as far as he was concerned we had used all his oil.
    LA asked my husband if he was prepared to make an offer and my husband said no..
    LL then said that he was prepared to "let us off" 1500 litres..how generous!..and asked us to have 1000 litres delivered..at a cost to us of £500.
    my husband refused and LL then said, well in that case I shall be making the deduction from the deposit.
    My husband said he wasnt prepared to discuss the matter further.
    worth pointing out too that we have discovered that the LL rents another property through this LA..so blatantly obvious they are trying to smooth things over as they are scared of losing his business.

    Even if he can find a receipt, he hasn't got your signature next to anything saying you'll pay it back? You did the right thing.

    nope! despite asking for this..LA refused saying the LL has 24 hours grace to check he is happy with the condition of the house, then we will be sent a letter stating if our deposit is being returned...we are not surprised as its obvious LL is going to try and find £500 worth of "damage" to the house!
    We did however take extensive photographs on checkout..because who is to say..given how unscrupulous he has been..that damage wont miraculously appear.
    We have also had the LA on the phone today to say that LL has already phoned the LA saying the boiler doesnt work and he is blaming us for allowing the oil to run low and will be charging us for whatever repairs are required to the boiler..
    He has also discovered that a built in wardrobe door has come off its runner..this was in my little girls room and was an ancient 1960's style built in wardrobe with sliding doors, of which one was off its runner when we moved in, we advised LL by email, his comment was..Ill have a look next time in the UK..

    This is very good advice-a friend had a similar landlord-didn't do repairs etc when she moved out he produced photographs from when the tenent before her moved out who was an alcoholic and had wrecked the place. It had to be gutted before she moved in.

    She had no proof when the LLs photos were taken-went to small claims-and lost. She was devestated.

    If she'd taken her own photos they'd have had a date/time stamp on them -and would have won. It never occured to her he would lie so outragously.

    My LL also lied - when we moved in there was some quite obvious damage to a carpet. Being naive we just assumed it was fine and lived with it for 2 years, and then he blame US for it despite it having been there quite obviously for many years. He sounds like he went to the same landlord school as your moron LL.
