LL wants us to put £1000 of CH oil in tank before move out

    You need to photograph that broken pipe/oil leak as well, it can only help your case.

    we have indeed photographed it..just in case.

    Just out of curiousity..when should we lodge a dispute with TDS?
    our TDS paperwork says that the LL has 10 days from the end of the tenancy to either agree or disagree to return our deposit..should we wait for him to do that?

    Wait the ten working days and then lodge a dispute. Lodging one now might slow down the process as the TDS will freeze your deposit and start the investigation process.

    I would write a note to both LA and LL immediately expressing your disappointment that no inventory was done when all 4 of you were in the property at the same time on teh final day of the tenancy and reminding them of their obligation under TDS rules to deal with this matter by xx date,

    this will be evidence to show the Arbiters that there was very little good-will on their part.

  • well weve finally had our move out report but as yet, LL has not communicated re: the deposit..we have noticed with interest that he is also claiming that wood and coal were also missing..we hold our hands up to the coal as during the 4 weeks that we had no heating, we used what coal was in the bunker..my husband est that there was probably about £30 in there, but we did not have time to replace this due to how quickly we had to move out. There was also a felled tree in the garden, during the time we had no heating LL emailed us and told us to help ourselves to this wood so we could light the burner, my husband chopped logs from it and naturally had we been staying until the end of our tenancy we would have cheerfully chopped some more logs for LL but simply didnt have time as we had such a short time to move out. Yet again, he is claiming that his coal bunker was full and that we have used all the available wood from his garden, which is asking to be replaced by way of a log delivery..not entirely fair given that it was a rotting old tree, not a log delivery we used and considering we were without heating and were not given a rent rebate..we would have thought he wouldnt be complaining about the wood.

    Again coal and wood were not on the original inventory

    We are now awaiting the written confirmation of how much of our deposit he intends to retain..thankfully the move out form says the house was in good order..

    sorry only read 1st and last page but FWIW . If LL uses the same oil company he should be able to prove that he filled up his tank b4 he handed over the keys IE A receipt for about 2k+

    no heating .... you use his old wood... he wants you to pay for his wood ???? words utterly fail me !!!! what a b*gger ....

    LLs like him make me ashamed to be one sometimes.......
