    I was just going by common sense. Things at that time of year take about 4 days to arrive (depending how they were sent), no post on Xmas day (when it was opened) makes 5 days, and I assumed the OP would post about it fairly soon after it happened.

    Kind of irrelevant now anyway, as they bought it in November :p

Empty cases have been in the news quite recently, the new Harry Potter release was hit by it (the special edition version) according to the Amazon forums.

    See i'm not totally convinced that they are trying it on. As if your going to scam theres a lot easier ones to do. Must admit i never new empty cases were in the news. The OP is being very silly anyway telling the buyer once its opened its not there responsibility. They almost deserve to have to refund for trying it on themselves
    if it's well over a month later they having your leg i would have thought the first thing you do is shake the box to see if there something inside
    Only a fool would shake a DVD case before opening it. If its not secure all you would achieve would be to scratch it. Ive never known anyone get a new DVD then shake it before opening thats just plain silly

    Also, bear in mind that the reason for the delay in notifying you of the problem may have been that the game was for a Christmas present

    How would you feel if you bought a game on eBay, it was empty and the seller said "tough luck chap" and kept your money?

  • Won't be the same person, but the same sort of thing seems to have happened to somebody else too, so I guess the buyers story is not impossible.

    sorry but i find this quite beleivable, i bought my dad a dvd in hmv and it had no disk in, ive also known a relative to buy a ds game which didnt have the game in after undoing the seal and a colleague had the same thing with a dvd, so it does happen!

    i would refund or send them another, after all theyve not got what they paid for! its not you fault, if its sealed you werent too know but its not your buyers fault either
