My dad and my self have been ebay sellers for over 5 years and an amazon and play sellers for the past 3 years. We sell mainly new DVD's as well as the ocassional Game or CD. Everything we obtain is sealed and thus cannot check to see whether or not the disc is in there.
When ever we have a customer say a 'there is a disc is missing' or 'i never obtained my DVD' we wont refund them the money as we believe they could be a scammer.
But we will send them out a replacement, but recorded post.
Say for example the DVD cost the buyer £20 you might of paid £10 from your supplier. Thus making you a profit of £10 minus postage. (Profit: £10 - p/p)
    1. If you refund you will be giving them £20 making a loss of £10 and postage (Loss: £10 + p/p)
    2. If you send a replacement you will be giving the equivalent of £10 and new postage. Meaning you will only lose out on postage.
All while keeping valuable feedback, cause in the internet world, great feedback and customer service is what can keep customers coming :)

Very sensible response. :T On the one ocassion that I received an (eBay) 'item not received' complaint, that's exactly what I did, too!

Well I think we could possible be talking about the same situation and he was trying to have you all on and give false information to make himself feel better. He's never come back to anything put on here at all and not responding to paypal requests. We've now sent our evidence and will just wait and see what happens now. Thanks for all the responses. There's no way we would go through all this just to get a "free" disc worth not much at all.... My Mum probably would have even brushed it aside but he was so damn rude that we are not letting it go. There's no way he can prove there was a disc in it as like he said it was sealed! We just want the game that was ordered and paid for as this was my Mum's Xmas present from my Sister.

I advised that they contact the number on the back of the manual for a repalcement disk and describe the problem as when the box is opened the warrenty with the seller is void. I don't understand why it would take nearly a week for buyer to get back to me.

i would say you are right with suggesting they contact the manufacturer, but afaik the contract is between seller and buyer, and technically the buyer should return to the seller for refund and the seller should contact the maker. I had a similar, where i sent out a box set with a disc missing ( think this was my fault tho! ) and the buyer contacted me, i contacted the maker and they sent a spare disc directly to the buyer. said it was a present etc...

  • What would happen if a private seller sells a used CD, and the buyer (scammer) claims there was no CD in the box. Would Ebay/Paypal automatically believe them, and if so, has anyone worked out a way of avoiding such an occurrence?
What is happening to the English Language? These are not isolated, but repeated every day.
'Definate', 'Aswell', 'Rediculous', 'Payed'...and the best of all 'Could Of'. How can anyone think that 'Could Of' can actually mean anything. You may as well write 'Could Zebra' for all the sense it makes.

    Not really, no.
You could fight it with the weight on the postage reciept, but a disc doesn't weigh significantly more than a empty case so you might struggle a bit.

They would have to return the case by paypals rules though, and people who do this all the time will get caught sooner or later.
This is my opinion. There are many others like it but this is mine

I am a professional ebay seller. I work hard at my job, I love my job, if you think it's silly that's your problem not mine. :p

Unwanted gift, but brought of high street, ??

Looks like you have brought a cheap game from market thinking you can make a quick penny, but it never worked out as it looks like you have been taken for the fool, also to do things like that dont you need a business account??

Its not hard to get dodgy games already shrink wrapped
