I'm of the opinion that you should refund them.
4. Unless you have the before and after weights, you cannot prove they are lying.
Im not sure the disk would weigh that much and make it much different, probably not in to a different postage amount - i am intrigued now as to whether or not it will, weigh one of my dvd cases with and without the dvd in too see.
I totally agree that you should refund, im not saying its the OPs fault there was no disk in, if it was sealed you werent too know, you shoudl go back to the game manufacture and explain situation. As for the buyer its not their fault there was no game in the case and it could have been apresent hence why they havent opened it yet, i ordered a wii game back in nov on play and only today got round to opening it to play it as ive been far too busy!0 -

There was a thread in consumer rights (I think)about some scam where boxes were being opened in shops at the bottom of the wrapper, the disk shaken out, then the cellophane re-sealed, and the game then sold in good faith by the shop.
Sounds like the seller should accept it back, refund the buyer, then take it up with the shop it came from.0 -
if it's well over a month later they having your leg i would have thought the first thing you do is shake the box to see if there something inside

My sister bought a game in Woolworths (obviously some time ago!!) and when it was opened the box was empty. When we took it back to Woolies the assistant, understandably, was sceptical and called for the manager, who did agree to an exchange. The new one was, of course, also in a sealed box and my sister asked could she first open it at the counter to make sure the disc was inside. The manager agreed and while she was unwrapping it I did notice the manager and the assistant exchange "a look":rolleyes:, if you know what I mean. I nearly laughed out loud at the pair of them when, lo and behold, it was another empty box!
They were, of course, very apologetic at this revelation and offered a refund. As the game had been a birthday present, my sister asked could they open another one or two just to check as she would prefer to go home with the game. Fortunately, the next one they opened did have the disc in.
However, as there was no way to tell whether the disc was inside without opening it they did say they would have to send their complete stock of that particular game back to their supplier...0 -
My dad and my self have been ebay sellers for over 5 years and an amazon and play sellers for the past 3 years. We sell mainly new DVD's as well as the ocassional Game or CD. Everything we obtain is sealed and thus cannot check to see whether or not the disc is in there.
When ever we have a customer say a 'there is a disc is missing' or 'i never obtained my DVD' we wont refund them the money as we believe they could be a scammer.
But we will send them out a replacement, but recorded post.
Say for example the DVD cost the buyer £20 you might of paid £10 from your supplier. Thus making you a profit of £10 minus postage. (Profit: £10 - p/p)
1. If you refund you will be giving them £20 making a loss of £10 and postage (Loss: £10 + p/p)
2. If you send a replacement you will be giving the equivalent of £10 and new postage. Meaning you will only lose out on postage.
All while keeping valuable feedback, cause in the internet world, great feedback and customer service is what can keep customers comingTech Savvy Student trying to help and learn

Marvell Kid, That is a very very good post. Its very true, and works out best for both parties, providing they are genuine. And if they aren't, they end up with two games(yes i know they can sell the spare, but id be inclined to say its far to much grief!) instead of the game for free. I must admit, i would be totally gutted if i ordered a game and the disk was missing, especially so if it was a christmas gift, and my little one opened it to find it empty.0
