    Hi Dalym, Glad you found the ebay thread (I posted on your consumer rights thread to tell you to come here). Hope you get it sorted but how do you know its the same person as the OP?

    I wondered the same myself. Thought it was just coincidence that two people had posted with the same sort of problem, but dalym seems convinced it's not.

    Coincedence maybe but PS3home isn't really unique as anyone with a ps3 knows what it is, suppose will have to wait and see what the OP has to say.

  • The eBay sellers username isn't ps3home though, although I did wonder at first if that was the connection.

    I'm wondering now though if perhaps the messages ps3home claims to have sent their buyer have sparked some recognition in dalym?

    I'm of the opinion that you should refund them.

    1. If they were scammers they would have tried it on right away.
    2. If their feedback showed they were a problem buyer you'd have mentioned it by now.
    3. It happens, as proved already in this thread.
    4. Unless you have the before and after weights, you cannot prove they are lying.
    5. The date of purchase to point of complaint should be fully understandable to you, it's highly likely that sealed games purchased in early November are going to be for Christmas presents, so won't be unsealed before then. Sticking to the letter of the law and being unflexible about it means I wouldn't want to buy from you, so a neg would be deserved IMO.

    Do the right thing.

    I'm pretty sure if you took a box back to Tesco and said there was nothing inside it they would take you seriously. Also if its faulty they would refund. Even so large stores don't always bothered by follow consumer law and are often found guilty of various misdemeanours.

  • Ebay username stephe7n is the seller that dalym purchased from, so I don't think the NARU seller ps3home has anything to do with this problem really.

    Really intrigued to see if these two problems are actually connected though.

    I dont think that OP and the other poster on here are talking about the same item. The 'buyer' who claims this post is about her game has a clickable post and the sellers profile doesn't look like the OP's to me. OP says he has sold loads of games, the seller that sold to the 'buyer' (with me?!) sells mainly football programmes. The OP also had trouble with a broken PC screen in an earlier post.

    I would suggest that neither posters on here are talking about the same item and it's just an unfortunate coincidence that they are in the roles of a buyer and a seller.
