Ebay dispute: no game in box - being called liar!

Was wondering whether someone could help.
My sister ordered a DS game for my Mum for Xmas. It arrived in it's celephane wrapper and wasn't opened until last week. My Mum being courteous put positive feedback on the sellers site saying arrived etc, thank you as she knew my Sister wouldn't get round to it!
She opened the box 2 nights ago and phoned me to say you never guess what, there's no game in the box! Now I know she probably should have checked all was ok before putting on positive feedback but being the nice person she is didn't and just put positive feedback anyway. She then sent an email to the seller who turned around and said you're a liar, first you say it hadn't arrived when I knew it had been signed for, this took him 2 days to reply to so obviously it had arrived by the time he checked it, then said, i'm going to report you, you're a liar and you're not getting your money back, i'm one step ahead of you etc etc. My Mum is a nervous wreck, she's definately not like that and is an absolutely shaking mess. She's just replied and said that she's going to report it to eBay/Trading Standards. He now says it came from a shop therefore he "knows" it's not empty. He must x-ray eyes then as it was sealed! Is there anything else she can do as eBay have not returned her email and this was yesterday morning she sent it? This guy is getting really nasty for no reason.

Dalym, you might be better posting on ebay board with this one. Soolin who looks after the board is very good with giving people help as are other posters. Not suggesting this isnt the case on Consumer Rights but as its Ebay specific you might get more specified advice relating to what your ebay rights are.:smileyhea0

Actually, I'm sure on the ebay board there is someone who sold a game, and the buyer is claiming there was no game in the box... I wonder if the two are connected?!?!Should've = Should HAVE (not 'of')

Open a Not as described dispute in paypal. You will have to return the item tracked for a full refund.
Then leave the seller appropriate feedback and DSRs0 -
A thought came to mind, is the postal wrapping still available? If so does the postage stamp include a weight or does the postage price indicate a weight category? If so what would the weight of the parcel containing the game have been etc etc?0
