    well mine has been despatched...price matched by CURRYS:beer:...i had 2 games reserved at argos for sons 360,due for collection today...but went and got them at currys instead as well...as they were so good with the DSI....

  • As Argos hasn't been trueful with many of us, & have broken the law in some cases, may I suggest everyone affected complains to

    It worked with the gamecube case in 2004 with Tesco & Woolworths.

    Over 900 forums posts from MSE & HUKD combined, if watchdog was to receive this many complaints, believe me it would appear on the show & give us all a chance, come on - get posting!!!

    im stuck on doing anything till i know one way or another, id like to think argos would have given my the curtosy of a phone call by now but alas still nothing grrr, so im sat here still waiting no idea if i will be very very lucky and recieve or if there just going to well not contact me

  • I was believing that if money was taken then a legally formed contract had been made ( watched a programme on bbc3, anyone see it? ) well he basically purchased a ipod for £19.99 instead of £199.99 but afterwards when he got out of the shop ( they planted an alarm in the bag ) she refused to sell it. It later went on to say that once the item has been paid for and monies have been exchanged then the item now belongs to that person! So if money has been taken from accounts and they have then refused to sell, explain that you're within your rights to sue as a legally binding contract has been formed as monies have been exchanged.

    a contract is formed once payment has been made.
    if you see somemthing for a lower price legally the store do not have to sell it that price - they normally do as its good customer service but legally its not a formal contract until you get to till and actually pay for it. once paid they can do nothing about it

    with this problem your phone orders were accepted and should be honoured, they are breaking the law!

  • I keep checking my online banking to see if money has been taken from my credit card, nothing yet- I presume that means I haven't made this "contract" yet?

    Argos are arguing that until you have the item in your possession then a legal contract has not been formed. My argument is that they have taken my money, the item has been dispatched to me and has left their possession and is now in the possession of a courier - they have recalled it.

    I explained that lots of people had been allowed to purchase from instore yesterday and some had even been delivered today. They are saying those people were 'lucky'. I am saying it was not flagged as a pricing error on their website (it said Save £70 like any other sale item they have), or their telephone check & reserve service or by their customer service representative when I specifically asked when purchasing over the telephone from Argos direct yesterday.

    They say are quite within their rights as detailed in their terms & conditions, I said those terms and conditions were never quoted to me during the telephone conversation. They have taken my money & dispatched the item to me, only to recall it 24 hours after purchase from the courier company.

    I have told them I will be speaking to Watchdog & the Trading Standards Authority. This is obviously a Sale item that they didn't want to honour - except for very many people who went it store yesterday (I had no stock near me) and for the lucky few who have had theirs delivered today.

    Just wanted to update you all on my rant of the day!! :mad: Thanks to the poster who has pasted the Watchdog link, I'll be doing that now.
