yes they can , they can also refuse you when u go into store

there was a glitch the other week , i paid for items had confirmation email and delivery date , and the evening before delivery they called me and said sorry the item you hhave ordered was priced in correctly , you have 2 choices to pay the coreect price or cancel order.
they had taken money from my account but refunded 2 days later after i said no i do not want at that price ,
so even if they do take money from account they can still charge you full price , but they will ask you first

I don't quite understand your post? You seem to have effectively agreed with everything I said in the two posts of mine that you quoted.....

Buying in store and buying over the phone are two very different things.

As I said in my post, if you reserve for purchasing in store, then Argos are within the law to refuse to sell you the goods because no contract was confirmed.

If ordered over the phone, and the order is confirmed, both parties agree the terms (ie price) and payment is made then they cannot increase the price after the phone call, and force you to accept it.

i am saying they do NOT have to honur any price instore or online or over phone,

as said earlier , i ordered some things s few weeks ago with a price error , money taken from account , email to say being delivered next day , 8pm that night had a call to say wrong price do i want to pay the correct price or cancel order ... THEY DO NOT HAVE TO HONOUR PRICE

    from there site HERE
    b) While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

good luck if you get it from phone orders ,, i dont realy care now as i got mine this morning at this price ,,
Dont forget that little Thanks button , only takes a sec

So what you're saying is they can cancel the order but can't make you pay the full price. That's exactly what I said in the posts that you quoted lol.

I reserved one at the back of 11 this morning then rang customer services as I realised there was a special offer with games and the accessory pack. By that time they wouldn't order over the phone but the guy told me that I could go to the store to collect it where we were to ask for the manager if there were any pricing problems and have it resolved there (ie if they wanted to charge £149.99 instead of £79.99).

Hubby went in at lunchtime, had nothing but hassle. They refused the sale and refused to believe what customer services had told me. The manager wouldn't even speak to hubby at first and kept sending someone over to him! Eventually they allowed him to ring customer services where he was told that unless we know EXACTLY when the call was made from our hjme phone, they can't help or honour but that if I can find out the time they cal listen to the call as all calls are recorded. Just as well I can access my phonebill tomorrow morning and get the details!

I bet they think we'll just go away as it's a lot of hassle. They don't know me at all!!

Hubby was disgusted by the store manager and his attitude.

Has anyone tried the price match at currys

Curry's will know straight away that the Argos price is an error (on account of Curry's selling them at £150, and also the fact that they deal in electronics), also in the terms it says the retailer (Argos) must have stock available to purchase, which they don't.

UPDATE: Curry's have refused the price match on account of not meeting the terms - because it's not available to purchase, but Gamestation have accepted the price match for one HUKD user!

Just got back from our teeny little Argos in Minehead, where they obviously had not read the memo, with my DSi. Put the catalogue number into the stock checker and it came up with the price of £79.99, wrote down the number and went to the till to pay where the young lad manning the till put it through without comment. Thanks OP.
  • :j:eek:Many thanks to the OP,managed to get one for DS's bday in Jan.

Said I wouldnt get him a DSI as so ££ but at this price it was too good to leave!!

If payment has been taken, then they have to honor the deal as per the sales of goods act. A price was advertised (error or not) giving an offer to treat. If Argos then take payment they have accepted your offer to by at that price and have formally entered a contract. This is why many online stores dont actually charge you until dispatch giving them ample time to resolve any errors. Argos and anyone else can write what ever they like in there terms and conditions but if any of those terms go against your statatury rights, your rights overide the terms and conditions. If payment has been taken argue the fact, if payment hasn't been taken then you don't have a leg to stand on. If you was in the store and they advertised it instore at £79 and only charged you £79, they cant call you up later and say we've made a mistake and would like our other £79 please. The same applies to online purchases as well as high street purchases.
if i had known then what i know now
