    hi, the job i do requires two people there, as use 6 meter staging and ladders. cant set up or work alone. I work 6 days a week, branch manager didn't work saturdays anyway! I did speak with him via phone fequently. The manager also asked me back to see him. These appts were generally at around 3.30pm, so i lost a few hours a day working.
    i have reported the SAR to the ICO, and they are reviewing it. i have reciepts for letters , phone calls etc...
    i know that i prob stand little chance, but i work with one person, am not a big company....this has affected me. Just ,little things, such as not be able to sell my old van before the mot ran out, as got declined for a new one! just annoys me that Natwest think its ok to do this to me and not cover my losses!

    Thing is credit is a privlige not a right. no idea what 6 meter staging is I presume somthing to do with scaffolding but thats a rough guess. Told you I play with numbers for a living.

    From the way i see it natwest had the problem brought to there attention they corrected it for some reason the probem arose again they apologised corrected it once and for all and gave you a GOGW for £250.

    I am not being rude but in your posts certainly at the start and middle of the thread I strugged to work out what you were on about, your handwritten letters are the same. It is quite possible that until you talked to someone face to face ossibly several times that they finay understood the issue and once they did so corrected it. I do not believe that someone at RBS group has been maliciously giving you late ayment markers I just expct its a computer issue. Say you pay 30th Jun 09 then your payment date is changed to the 1st of the month. The next payment is 1st August 09 so the computer thinks you have missed the July Payment. It then allocates Aug ayment to july Sep ayment to august and so on making it look like you are always one month behind. I guess someone manually adjusted your credit record but not until after the date that RBS/natwest sends info to CRA's when told about that they sorted it and quite promptly it seems.

    The argument will no doubt be credit is a privlige not a right. They corrected and error within a reasonable timescale once aware and offered a goodwill gesture when a further error was brought to their attention.

    I think £250 is quite generous.

    I thought this site was about the little people not putting up with being pushed around and bullied by the big companies, not putting up with poor service and the company then saying," who cares".
    When Natwest mis- sold me the ppi, that started all of this, they only cared about profit, not if it was the right product for me. When i cancelled it, Natwest changed the payment date, without informing me. Therefore, putting late payment markers on my credit file, even though i made every payment. I wouldnt call that a privalige.
    Thanks for your views, its like hearing the objections I supose Natwest will use in court. Thank you for that, but if you do work with numbers you will see they dont add up. cheers

    Just my opinion you are way over the top.
    What if you sue the bank and you lose do you have money to pay legal expenses (I mean tens of thousands!)?

    Not a question of the little guy being overrun by the big guys - just common sense and just my opinion.

    the principle of the small claims is that each bear their own costs unless they can show you have been vexations in bringing the claim unjustifiably e.g if you discontinue without good cause after they have submitted a defence, also(tens of thousands) its only the small claims.now that is way over the top

    THE UNFAIR RELATIONS PROVISIONS (FROM THE OFT).
    The unfair relationship concept orginates from cca 2006,which is an amendment to cca 1974 section 140A(1a-c)of the cca 1974(as amended) gives description of unfair relationships.
    section 140b(1) gives the court a wide power to intervene in the agreement.
    section140b(9) puts the burden of proof on the creditor to show the action they took was fair to the consumer.
    Also,section 150 of financial services and markets act 2000 allows individual consumers to make claims for unfairness in fsa regulated agreements.
    Any thoughts ???

    Wouldn't apply as natwest/rbs fixed the error once made aware. 140b(9) creditor made aware of problem and corrected it, one late maker accidently slipped thru net they made aware and corrected it again and offered a GOGW. In my opinion that is fair.

    This site is about moneysaving and not throwing good money after bad. You taking out a small claims action is, in my opinion, throwing away money you could be using to clear your liabilities. You have no evidence of loss. The bank have been fair ay you seem to want to continue pushing for more and more.

    Not one person has agreed with you, I think its time you just let it go and concentrated on paying back the loan.

    Finally rebuilding my Credit Record :), HP loan to be paid off Feb 2014 and thats it :j
