    Why would you consider he may carry straight on around the roundabout, he was in the lane to go left, thus this was an indication of his intended direction, and for him not to see the OP (as he said he indicated left) then he needs his eyes testing!

    correct, and he should also indicate left to confirm his intention.

    It's called defensive driving and it's what most of us do to keep ourselves and our families safe. It's like not pulling out of a junction in front of someone who is turning in to the junction just in case they change their mind or are actually heading to the next driveway although it's 50 feet ahead. In my case I assume all drivers around me are muppets and I assume they are going to do something stupid in all circumstances.

    Roundabouts are there for people to drive around and drivers should ensure that their path is clear when leaving and yes that involves using one's left mirror and preferably looking out the left window and if necessary over the left shoulder.

    The majority of accidents could be avoided if one of the parties anticipated the actions of others and drove defensively.

    As I've said all the way along, it looks to me as if Subaru man was in the wrong lane but with some anticipation and awareness the OP could have avoided him and saved himself all of this aggro.

    Dead is still dead whether you are in the right or the wrong.

  • Whilst I commiserate with the OP, there are many muppets around that travel all the way around the roundabout in the outside lane and I've ended up staying on the roundabout in the OP's position when trying to exit onto a dual carriageway, because the person in the lane to the left of me hasn't exited the roundabout. :mad: Annoying as it is, as the other driver is incorrectly positioned, I'd guess it's your responsibility to check you way is clear before exiting the roundabout. I do check to my left blind spot to make sure there are no cars, motorbikes, cyclists etc before I exit 99% of times, but I'm not slating the OP, as there but for the grace of God go I - none of us are perfect :o (although reading some of the posts in this thread, a few people clearly think they are :D).

    The outside lane being on the right, those muppets you speak of are in the right ;)

    The only issue here is proof. Without a 3rd party or photos from the time, you might be stuffed.

    Interestingly enough I received a minor on my driving test for not checking over my shoulder when I performed basically the same manoeuvre as the OP, although the lanes weren't marked.

    I would however still say that the OP was in the right here and the man who hit him should be held responsible; the lanes are clearly marked.

    Bikingbarney, I wouldnt be accepting any less than 100% fault free in your favour. How anyone can say you should take ANY blame is beyond me.

    Sorry to bikingbarney, the picture had not loaded and had not seen the original posted picture. If i had seen them i would not have said you are most likely wrong.

    I have now had a look at all the pictures and i can only be certain of one thing and that is if the other driver accuses you of not signaling or saying that he was in the wrong lane and noticed he was and signaled to go back into the right lane and had the collision, this will make everything more complex and the TP will take its time.

    I am certain now that this accident is not your fault in anyway, (now that i did have a look at all the pictures) however as someone posted previously you should have called the police and the police report would have worked in your favor. Please make sure that your solicitors or insurance get all the pics and evidence you have about the incident this should speed things up. However i think it maybe a 50:50, you can never really make 100% sure of any of these things but i hope for the best. One of the other facts to be pointed out is that the Third Party's right of way is taking the exit, so by taking the exit yourself you have not disturbed there right of way. Instead by not taking the exit they have entered your right of way and colided with your vehicle. Right of way is very important in claims.

    There was a post about what i said about the person driving under the influence. Please read you insurance T&C. It states something on the lines of if you drive under the influence, this will void your insurance. Something on the lines of this, i found this out from a no win no fee company and my solicitors. I had a drunk driver hit my car while it was parked and i managed to get him to stop called the police, but before they came he drove off without exchanging information. I noticed the heavy smell of alcohol in his breath as we argued. The police went to his house but did not breathalyze him for some strange reason and the police have informed me they cannot do him for drink driving as they did not catch him on the act and that its hard to prove as he can say he just had a drink as he got home.

    Long story short i have been notified that we may not get paid from TP as they may say that his insurance was voided due to drink driving. Also i have heard that if someone hits your car and then does a runner, the person doing the runner will have there insurance voided. This way the driver who did the runner will not get any compensation what so ever and also can cause problems when the innocent driver is claiming. However i am damn sure that you can always argue that the insurance was valid at the point of accident. I just believe this is crazy.
