    thanks for all the replies.

wife has been to see a doctor as she is having difficulties standing/walking/sitting/sleeping.

she has a trapped nerve in the leg that was against the door that took the impact which according to th doctor is a symptom of a low impact crash.

i have just contacted my insurance and because i do not have legal protection on my insurance they do not do personal injury claims??

    is this right??

You have to sometimes add on legal protection. But dont worry, you still have the option of going to a solicitor who can work on a no-win no-fee basis.

I did this, and kept all my compensation received (lawyer claim their costs from the other persons insurance company). They arranged me to see a specialist at hospital to make an assessment of physical injury. Its pretty straightforward and something you should do now to get the ball rolling.

    Will PM you.
  • On First reading I thought OP maybe in a bit of bovver, as the bukeroo was attempting to try all the lanes. Then I remembered the Junction and I think as the OP was going on the A38 into brum (don't nose why!!!), then I suggest he gets a plan done of what happened and his insurers legal peoples as geared up.

    Good Luck

    me too please
  • I use this junction a lot (I think its called lydiate ash), if the OP were in the middle lane at the lights before the A38 turn off then he could have gone on the A38 or round to bromsgrove or further round to M5 south. The other driver being in the left hand lane could not go anywhere else but the A38 to birmingham, the fact that the road is clearly signed means that it cannot be the OP's fault and he must insist that his insurers fight this.
I have a lot of problems with my neighbours, they hammer and bang on the walls sometimes until 2 or 3 in the morning - some nights I can hardly hear myself drilling ;)
  • On second reading of this epic, one's thought first springs to Subaru and Prat. Always think prat when there is a Subaru in the area and give a wide berth.

Then one thinks of the whiplash injuries that may have affected the misses! Then one thinks hang on here. If both cars had stopped at the lights, either on the Motorway slip road or at the exit to the A38, both cars would have a standing start and my bets would have been on the Subaru winning. And if the lights had been red, then the collision speed would have been less than 5 mph from the standing start, as both would have been accelerating away, hence no whiplash, unless he hit op from the behind?

Then one thinks, Subaru, head loose, boy racer incident? Next time do not race!

Next time one sees Subaru, think PRAT AND STEER CLEAR!

erm ok........ except no one is saying anything about whiplash!!
if you actually read any of my posts you will see my wife is having problems with her LEFT LEG as it was against the door which the other car hit.

thanks though for your input and happy new year.

If a party is injured in the accident, the police should be involved?

    Are the police invloved?
  • the police were contacted at the time of the accident but as there were no apparent serious injuries at the time, the police did not attend
