Don't take it personally bikerbarney - the very nature of discussion forums means there will always be different views.
The benefit you have now is that the posts in this thread have prepared you for almost anything the insurers throw at you (in the event they try to share liability, etc.) so you're in a better position now than if everyone had simply agreed with your viewpoint.

I had a similar thing happen to me on a roundabout in Coventry... only difference was that he went nose first into the side of me causing £2.5k of damage.....
I had my parents in the car and apart from taking a mug shot of the driver (just in case!) I made sure that my parents wrote down their accounts of what happened and put them in with the claim.

ive spoke to my insurance today and they have told me that my wife cannot be a witness??
also spoke to his insurance to check that they agreed to cover the cost of a like for like hire car and they have denied speaking to the hire car company??0 -

Strange response regarding the courtesy car. It was your insurer who issued you a car from Enterprise wasn't it? Then Enterprise spoke with the other party's insurer who supposedly agreed to pay for a like-for-like?
What have you had to sign for the car? Whatever documentation you have been given, check it over very carefully in case someone at Enterprise has got a credit hire company involved.0 -
hi all thanks for the replies.
ive spoken to enterprise regarding the hire car and they have said it was there liability department that have looked at the details of the accident and have decided to give me a like for like car as they have a good chance of recovering costs from the other parties insurance??
which i thought was strange so i asked what happens if it does actually go 50/50 and then they said they would foot the bill not me.
nowhere on the papaerwork does it mention a credit hire company.0 -
and with regards to my wife being a witness , when i first contacted my insurance they toldme should could be a witness, however the chap i spoke to today apologised as i had been misinformed.0

my insurance company also said that if he tells the truth in that he wanted to carry on round th island lie he told me at the time then he will have to accept responsibility for the accident.
however he also said that if he makes a story up and says i hit him then it will go 50/50 and thy wouldn't take it to court to fight it .
starting to get fed up now as i feel my insurance company is giving up already0
