had a crash today :(

I was on my way upto my fathers in birmingham with my wife and two young boys in the car.

We pulled of the m5 at junction 4 to continue up the a38 into brum.

I noticed a subaru forester pull off the mway at the same time and swap lanes about 3 times untill he chose the lane i was in , so let him pull infront of me to go round the island.

halfway round the island there is a set of lights to stop you to allow traffic coming south on the m5 to get onto the island.

at these lights there are 3 choices ,left, middle or right lane

left to go up the a38 towards brum, middle goes up a38 or right towards bromsgrove, right goes bromsgrove or back onto m5.

the subaru pulls into left lane and i pull into middle lane as im going up a38 but dont want to get stuck behind the old boy in the forester.

anyway lights go green and i follow my lane onto a38 and BANG !! im like !!!!!! .

this subaru has just drove into the passenger side of my motor

so i pullover and check my wife and kids are ok (4.5 year old is crying and the wife is saying her leg is hurting!!)and i get out and the chap has got out his car and said its all my fault as i pulled into him ??

i asked him where he was going and he said bromsgrove and i said he was in wrong lane etcand he wasnt having ny of it.!!!!

whre do you think this will go with the insurers then as i know im in the right and the old boy was to interested in his tom tom to look where he was going.

luckily my boys and wife are ok now even though the wifes legs is giving her some grief nd my boy is sayng his bones ache!!

lots of dents all on the passenger wing door and rear door too.


how do i do screen grab from google earth to show you the island in question??

I can't really help only the insurance can really but he was in the wrong lane so then its his fault, he was in the left lane to go right? surely anyone who drives knows not to do that!!

Hope you're all ok, it must have been scary for the children.

Make sure you tell and draw a daigram of said roads so the ins ppl know exactly what happened.

You need to be clearer, were you exiting the roundabout at the time of the collision but as he was in the wrong lane he was still on the outside of you?

Unless you got a wintness to corroborate your version of events(?), I would guess this will end up knock for knock.

if there was a diisagreement over who was in the correct lane, then you should have called the police. I suspect that if the other driver was in the wrong and was trying to bluff then the thought of a conviction for driving without due care in addition to a loss of his no claims may concentrate the mind.

If another vehicle (not turning right) was outside you would you still have pulled across?

i called the police but as there were no serious injuries they would not come out?

I think this may be where things started going wrong, don't you?

Be considerate to other road users, they might need your lane more than you figured before you monopolised it :rotfl:

I don't mean to be harsh, bb, but driving ain't never been an exact science, and we all make mistakes - sometimes they are embarassing, especially when we'd already thought out what the other guy might need to do next even before he has . Trouble is, if we're too quick thinking, we need to think two steps beyond the point when the other guy's penny drops confirming to him that he's in the wrong lane without a clue about what the quick thinkng guy alongside him just did (if you get my drift)

I am pretty sure the insurers won't be at all interested in arguing the toss on something like this.

Was he a nice old boy? Any marks on his forester?
