The left hand lane only allows the vehicle in the left lane to take the first exit, NOT to continue on the roundabout.
The middle lane allows the option of taking the first exit in its right hand lane, or to continue along the roundabout.
The other driver was in the wrong to attempt merging out of the left hand lane, perhaps he realised at the last minute that he was going the wrong way, and rather than doing the correct thing (continue the wrong way, and turn around at the next r/bout) he decided to barge his way back onto the roundabout, not realising that bikingbarney wasnt staying on the r/bout but was instead taking the same exit. but in the right hand lane. Cant see how this can be barney's fault whatsoever.0 -
I also drive through that junction a lot, and I would agree that the OP drove through it as intended by the markings, however it isn't the easiest junction to negotiate if you don't know it. When I head north up the A38 I always stay in the left lane as I've seen so many people do the same
manoeuvre as the Subaru driver in the OPs post.
Just one other point the google aerial picture is out of date as the junction has been widened with new road markings since that photograph was taken.

oh and just to add we were the first cars at the set of lights, no other cars around0

Of course you cut across him, he continued around the roundabout in the left lane or what became the left lane and you left the roundabout from the middle lane thus crossing the left lane.
A perfectly correct manoeuvre but surely you know that you have to be aware that those on the left lane don't always leave the roundabout in the correct manner?
As I've said the precedent case is Grace v Tanner which is a Court of Appeal case.

the left hand lane he was in only goes up the a38 he does not get the option to carry on round the island, look at the markings in the photos, it clearly shows this.0 -
You shouldn't have anything to worry about OP, just ignore the people on here that haven't read your post and looked at your photos. Just let the insurers sort it out between themselves :-)

The probability is that the insurers will treat it as a 50/50 initially, but you (as mentioned above) should give them all available info showing that the person who hit you was in completely the wrong lane for their movement, and in the process ignored rules 184 and 186 of the HC. Unless you actually SAW the other driver footering about with his SatNav, then it is only your opinion, but if your passengers also noticed it, then it may improve your case, since they were then driving without due care and attention. In any case, you really should have called the Police, especially if people in your car were feeling sore or unwell. They don't have to attend if there are no injuries, but reports of injuries WILL get them out.Fight Crime : Shoot Back.

The fact is, it was the other vehicle which encroached into his lane striking the OPs car. Blind spot is just to be used for overtaking, which is not the manouver the OP was making. I certainly dont check my blind spot just to have a 100% view, only when I wish to overtake or I know a motorcyclist is cruising around the car and want to keep an eye on them.0 -
