    gsmmad here are a few pictures......

    i was in middle lane and he was in lane my left

    this one shows marking on floor as you come up to the lights............

    this next one clearly shows the markings from his lane to go round to the left, not carry on round the island

    as you can seeby the markings i was well within my rights to use the middle lane nd exit into the outside lane of the a38n. at no point did i stray into his inner lane.

    the chap was to busy playing with his sat nav imo

    To me that picture makes it look like its perfectly acceptable to keep going round in the left lane.

    Are you sure your right about the lanes.

    the lines are hatched and carry on round to the left and send the lane up the a38n

    only the middle and right hand lanes get the option to carry on round the island
  • The middle and right lanes are to go right, the middle and left lanes are to go left. This is so basic, I can't believe peeps are arguing the toss. There's a lot of morons on here who shouldn't have passed their driving test, and if they did as they say on here they certainly wouldn't today.

    The only thing that might get you on this is the fact that you entered his lane (technically) to get over to the right hand of the A38. He shouldn't have been in it, true, but I do think they would consider 50/50 on this one tiny fact alone. Truly unfair, as the other car is very clearly in the wrong, the markings on the road are clear etc.

    Keep these pictures, OP, and send to the insurer. There's a good chance his will have to admit liability. Good luck!

    PS I hate the A38, one of the most badly designed and dangerous A roads in the country. When we had to drive it regularly I could never relax.

    the left hand lane is marked to go to the inside land of the a38, the middle lane is marked to the outside lane of the a38, it doesnt cross into the inside lane.
    basically 2 lanes go over to the a38 but the middle one gives the option of carrying on round the island to the next set of lights.

    This is quite a normal road set up. Where I join the A19 everday you have a similar set up. The inside lane is for the inside lane of the A19, the middle lane is for the outside lane of the A19 or to go right, the far right lane is to go right only. The number of muppets who go into the far right lane then try to cut people up by trying to get into the outside lane of the A19 is unbelievable. I always take the left for safety, but I often here honking horns behind me because of this problem.

    What the other driver should have done, after finding himself in the wrong lane (this can happen if you don't know the area) is to indicate right whilst standing at the traffic lights. You then could have been made aware that he was planning to go right, or at least if he wasn't, you would have pulled away from the lights as if he was, perhaps letting him go first, thus avoiding an accident.

    It was clearly his fault as the indication could have prevented all of this.
  • as i pulled off from the lights i stayed in my lane (which goes into the outside lane of the dual cariageway) indicated and checked my mirror i couldnt see hi due to the angle he hit my car at.

    You knew he was there though because you had chosen to go into the middle lane so that you didn't have to sit behind him you just assumed he was going off and that was a wrong assumption.

    You were in the correct lane, he was in the wrong lane but you cannot just drive through someone in this situation, you must ensure that your path is clear before you exit the roundabout.

    I appreciate you don't like my advice but I deal with litigation on claims like this for a living. You should have ensured that there was nobody to your left.

    I also drive through that junction a lot, and I would agree that the OP drove through it as intended by the markings, however it isn't the easiest junction to negotiate if you don't know it. When I head north up the A38 I always stay in the left lane as I've seen so many people do the same
    manoeuvre as the Subaru driver in the OPs post.

    Just one other point the google aerial picture is out of date as the junction has been widened with new road markings since that photograph was taken.

    Yes, but who drove into who?
    The OP had already exited the roundabout and the Subaru went into the back of him. The hatch marks clearly show the Subaru's lane, so in fact it's not the OP who cut lanes or drove into anyone, the Subaru cut lanes and drove onto the back of the OP? Or an I missing something?

    hi thanks for the advice.

    however i didnt cut through him , i stayed in my lane and indicated .
    i was obviously infront of him as he has hit the side of my car.
    he tried to cut across my lane not the other way around.
    he must of seen me as i must of been filling his windscreen.
