    well an update really ..........

    as im down the falklands serving for my queen and country i got a rather distressing call from my wife yesterday saying that i had recived court papers in the post as saga are taking me to court and holding me fully responsible for the accident??

    i managed to contact my insurance and they sounded so blasse about the whole situation and told me to get my wife to send the papers to them???

    what happens now then??

    Suggest you post this on the Insurance thread. Rewrite a summary of this thread (dates, events) - can your wife do this as I'm guessing you're busy down there?

    Ask for advice on the insurance process and these court papers. Direct people to this thread who want to comment on who was right or wrong. :)

    Hope the posting goes well and this is resolved soon so you're not trying to deal with it from thousands of miles away!

    No need to worry.

    This is a standard procedure used to get minds (of the insurers) concentrated on the issue.

    The court papers have to be issued against you rather than your insurer, but whatever the outcome of this (in or out of court) your insurer will bear any cost involved.

    As they have advised, you should just pass all the correspondence (unanswered) on to your insurer to deal with.

    no need to worry, its not even a 'knock for knock' case, full liability is with him.
    as you will be winning the claim on his insurance, you wont pay a penny, either now or in next years premium, enjoy!
    Target Savings by end 2009: 20,000
    current savings: 20,500 (target hit yippee!)
    Debts: 8000 (student loan so doesnt count)

    new target savings by Feb 2010: 30,000

    OP - anything else happened with this yet?

    I'm in a similar situation at the moment and my insurer has offered the third party 50/50 :mad::mad::mad:

    unfortunaltey its going to court now as his insurance seem reluctant to back down even though he admitted in his own statement he intended to carry on round the island from the lane he was in??

    I think of you every time I hit that point on the roundabout. I've seen the results of two accidents there since your OP.

    I now always use that left lane to head into Birmingham even when the middle lane is free, unless I can be first in the queue in the middle - in which case my foot hits the floor very quickly indeed!

    And no, I've still never even considered using that left lane to head towards Bromsgrove. I'm very sorry for you :(
