    ....CS lady was taking the empty box to put back on display so at this point I haven't actually got the PSP in my hand & 'noticed' the misprice....

    ....and then placed a new £219 SEL in its place....

    ....and intimated that I was lying!!

    End result - an ulcer and almost banned from this store....

    If an SEL is out of date, do they not have the argument that it says on the SEL that it stops on X date. So say you pointed out an SEL that says expires on 30th July and you buy it on 31st at a new higher price, do you a right to an R+R if they still display out-of-date SEL?

    They do potentially have an argument to this effect, but this is countered by the argument that the customer should not be expected to have to read the small print on such labels. If the label is on the shelf, then the customer is entitled to think that it is current and in all these cases should expect to pay the lowest price displayed. Out of date SELs are easily my most common way of getting R&R and good customer service people should not argue the toss.

    Welsh Ben & some other more switched on Dudes may be able to give you the precise wording...

    The Sales of Goods Act demands, amongst other things, that an item for sale be clearly displayed with a price.

    So ask CS 'Where is the correct price displayed for this item?'

    Of course - it's not there - so Tesco have broken the law displaying an item without a correct price.

    Forget about the expired date - that's not an issue - although CS will sometimes try and use this as an excuse not to R&R.

    If they do - ask the question again - and point to 'Our Promise' - nothing about dates there.

    Stick to your guns - be polite - don't read out the Sales of Goods Act verbatim - use a reasoned argument - and you should get there!

Obviously, I pointed out that since the yellow label was directly below the bottles I bought and since they didn't have any other variety of Adnams Ales, it was only reasonable for me to assume that this is was indeed the Ale on the 3 for £4 offer. She pretty much agreed, but said there was nothing she could do about it and offered to get the Duty Manager. He then came along and repeated what I had already been told. He agreed that it was confusing, but said that all he could do was feed my concerns about this up to Head Office. I could see from his whole demeanor that I wasn't going to get any further and I didn't want to get into a big row, so I took a refund and gave it up as a bad job.

    However, I know I was in the right and maybe others will succeed where I failed.

    Two out of three stores visited this weekend saw us get R&R's on the Adnams Broadside ales. However, the third store would have none of it - and as in your case, the only Adnams ale on the shelf was, indeed, the Broadside, but still CS would not budge.
    Words like 'misleading advertising' had no effect, but as the old song goes, "Two out of three aint bad".

    So, are you saying that the store must, by law, display a correct price for its goods? Whats the situation then regarding Tesco's annoying habit of whipping off all the SELs and not displaying a price at all, never mind a correct one ! Since I had some free bananas a week or two ago, my local has left the till price at 85p and just taken all the 65p labels off the trays as they put them on display (I've seen them at it). So customers have no way at all of knowing what they will be charges or if its the right price. They've also taken the washing powder labels off as well.

    And this is in a store where the CS has instructed me that I should be taking anything that I think might be wrongly priced to the CS desk before i pay for it - quite how I'm supposed to do that when there IS no price is unclear.

    The law is clear where two or more prices are displayed the lowest price MUST be charged or the item withdrawn from sale. If the consumer is charged the higher price an offence has been committed, the policy was introduced to avoid prosecution for misleading pricing indications so obviously appies.
