would you get this payment if on DLA and incapacity ?

No Incapacity does not get it. DLA might.

I have been on Incapacity and never once got it. Think I should get it this time as I am on DLA and IS as well.

No DLA on it's own won't get you a CWP, you need that qualifying benefit. IS or IB JSA or IB ESA or pension credit

Could somebody please clarify this for me

My daughter in law receives long term Incapacity Benefit and Lower Rate DLA for both mobility and care and my Grandson receives DLA Highest Care Rate and Middle Rate Mobility so I am assuming they do not qualify as my daughter-in-laws benefit's are not income-related? There is also a child under 5 years old.

I'm also on long term incapacity benefit and the higher rate of both components of DLA; none of these things are qualifying benefits for cold weather payments.

You are correct in your assumption that these benefits do not lead to further benefits as they are not income-related.

If you live alone your level of DLA will act as an "access benefit" to IS and a number of premiums. So you would get your personal allowance, disability premium, severe disability premium and enhanced disability premium, then they would subtract from that the amount of incapacity you get.

This is all provided you or your partner dont work more than 16 hours per week, have too much capital (I cant remember what the limit is), and a few other less important things.

You only get the severe disability premium if you live alone or I think with someone registered blind, but it would be worth getting a benefit check done possibly at the CAB to see if you are getting everything you are entitled to.

Even if after the calculation your are only entitled to 1p IS per week, you then get free prescriptions, full Housing and Council Tax benefits and again some other things.

i think you would get it as you get i/b but not 100% sure, forget dla itself you dont get it for reciept of that unless you get a disability premium, simple way to find out is get a mini statement from the banks hole in the wall, look for a £25 payment listed as dwp.
it was on account as CWP last yr just checked and my dads also entitled to 2 payments ...my daughter turned 5 on 30th Nov ...so i miss out on them now

    Hi folks

Just checked on postal code checker in regards of Cold weather payments and it shows that this have triggered 3 payments as from 1 Nov to 30 Dec 2009.
However, we have not received anything yet.

    This is the info here:
    Cold Weather Payment

    Results

The Met Office have notified the Department for Work and Pensions that 3 periods of very cold weather have occurred in the NP44 postcode area between 1 November 2009 and 30 December 2009, triggering Cold Weather Payments.
If you have qualified for Cold Weather Payments since 1 November 2009 and live in this postcode area, you should have received 3 Cold Weather Payments.

I am a full time carer for my son with autism who received High Rate DLA and my hubby on Income based JSA.

They messed up last year in 2008 as well.

I'm slightly confused about what you are asking
The first set of CWP have just started going out.
I'm assuming you get the disability premium with your child tax credits? If so you will get the CWP, it just take a wee bit of time to process them.

    Hi and thanks.;)

Yes my son is on the highest of DLA and receives the severe premium with tax credits as well.

Think its because of last year they messed up and we did not receive them all of when we were entitled to them then, I just keep thinking it may happen again this year.
But its showing 3 payments up to now in my postcode area.

But if its only now they are also dealing with them I can understand.;)

Just for me to know, if its 3 payments this have been triggered since 1 November, I take it they pay the 3 CWP payments together - is that correct?

    Thanks again.
