  • I was wondering if anybody has been on the Govan Law Centre website? They have published a very well written letter to send to your bank. It's not really a template as you have to complete examples as to how bank charges have affected you. I'm considering sending it to my bank.

    Hi, I posted a question here last month and thanks for your reply, but due to holidays and so on have not yet followed up my claim. I claimed for Bank charges on my business account approx £11K and received an offer of £780.00 from HSBC. You advised I try for more but am unsure how much to ask for? Are there template lettes for this? Thanks again for your advice.
    PS. I am claiming under hardship.

    Your specific issue is about the bank being incorrect in their administration of your account since I am sure you would have left sufficient funds to cover the charges had you been informed of this.

    No, complete the income and expenditure form with household income and expenditure and send in any notices of arrears that you have. Please do not use the phrase "milk it a bit more" cos my first reaction was not to bother replying to you or to help since it makes the situation sound like you are not in financial hardship and you are in the way of someone who really is. Apologies for being blunt but I had to say how I read it and what I thought. Let's be honest with the bank and maybe they will offer a refund based on the financial hardship you are in.
    Do you have any credit/store or catalogue accounts that you can also claim on?
    have you contact your creditors to see if they can help you as well?

    You need to read the lending code section 9 for business accounts and financial hardship. It will give you a guide to what you need to look for.

  • Hi,like many on here i've received a letter from my old bank saying that they aren't going to refund my charges,can anyone let me know what i 'm to do now ?

  • Hi i wrote to both HSBC and Natwest re my charges at the begingin of last year, both account to over £3252.25. back when the charges were made i was in financial hardship although not as bad as others as i rented at home and i had a job with no benefits. but the charges some times were over £50 - £125 per month. I was in a catch 22 where i kept going over my over draft as it swallowed everything up as soon as i was paid. Thanksfully i was made redunant which helped pay off a huge proportion of my debt, i was lucky enough to get a new job within the month and have spent the last year clearing back my over draft to zero and only have one credit card. So the questions are:
    • am i ok to continue to push forward on the ridculously high charges?
    • What help can i get to reinstate my credit score.
    I want to move out but can not get any kind of help to assit me, so it feels like im ain a catch 22 again!

  • Hi I also need to try and sort something out as follows:

    In January 2008 I was forced to close my business after 17 years trading due to bank charges and fees. My business (not limited) turned over 1.8 million pounds and we owed the bank £650,000.

    We incurred over the last 5 years of business over £154,000 in bank charges, £97,000 in overdraft interest, £172,000 in loan interest plus many tens of thousands in factoring and other fees forced onto us by the bank.

    It got so bad that the banks where taking much more than we where making their last supposed help? was to loan £30,000 for 6 months and charge £10,000 for the privelage. Also forced to have a financial advisor once a week at £1000 chosen by them to send the bank a report weekly. I had to sadly close the business and declare myself bankrupt making 30 staff redundant. All debts etc where taken care of with the receivers of the bankruptcy but the bank have personal guarantees for £650,000 loan as second charges over the 3 homes, my house, my fathers and sisters that they kindly let me do to try and keep my business open (in hindsight a very foolish decsion) but you do anything to keep going.

    As you can see from the above charges etc if the banks did not impose such crazy charges and fees basically ripped off my business I would still be thriving as it was profitable. Now they want to take all my families homes to repay the debt.

    If the bank was not so greedy with unfair charges, terms of repayment and forcing us to do things to survive I would have been able to carry on and pay the debt but they forced this closure through very excessive charges.

    Does anyone know of any similar companies, legal cases that have succeeded when challenging a banks behaviour or can advise on how I can attack this dreadful situation. Since the closure of my company I have had no money to fight this but I have to think of a plan as the bank are demanding a proposal before starting true legal prceedings.

    Any help would be very much appreciated. I am in financial hardship?

  • I have also had an '8 week' letter from Barclays, Is it still possible to claim for hardship for the majority of that period? I'm still have debts of £15K that I'm paying off, I went to see CAB 18 months ago and they gave me a payment plan which I'm stiking to.
    I still owe Barclays £3000 for a Resolve loan (old loan and overdraft), which is how much I was claiming back in Bank charges.

    Should I contact Barlays first or Ombudsman?
