    Read, copied to the forum here and have given links to Govan Law Centre who have already got templates readily available.

    To be honest Premier, I have already stated that it is frustrating that it is delayed since a lot of forum users are getting the 8 weeks or the complaint is closed letter and have got no advice from MSE how to deal with them. In fact, that is something that needs to be dealt with even if no guide is given as to new arguments. I hope MSE will be kind enough to give that advice.
    Oh I agree, it must be very frustrating to those who have been waiting this guidance that was first promised 4-5 weeks ago.

    However, as matters progressed (e.g. awaiting the OFT decision, the OFT deciding not to proceed, etc), it was as Martin wrote becoming "a complex legal argument". The latest email note effectively reiterates this by saying "there's a lot to get through".

    I guess that Martin & his QC is fully aware of the guidance given elsewhere such as from the Govan Law Centre, but has obviously decided not to publish that, something similar if it is protected by copyright, or even posted a link to it to suggest people simply adopt that approach. Why? Well I'll leave that for everyone to work out for themselves.

    In the meantime, note that Martin has again reiterated the basic advice from previous recent article editions:
    Do remember, while we believe some will still be able to reclaim, for most it will be tough, so plan NOT to get the cash

    I do agree with you and I have asked site team off the forum as well as on the forum about giving advice specifically towards those people who are receiving the 8 weeks or complaint will be closed letter.

    Premier, it is important that anyone reclaiming realises that as the collective challenge of the OFT has gone that they have to be prepared to understand the arguments themselves. The early cases which I personally expect to be heard either next month or March will involve banks' QC and may involve costs if the case is lost. Obviously understanding what or how the bank are defending the cases will have a big input into how to deal with cases going forward.

    I think we agree with the basic advice TODAY which is do not plan for anything(since we do not know how the banks are defending each case and neither do we know how successful/unsuccessful the case will be). In a sense we are back to the start of the reclaims campaign.

    I much prefer MSE Martin's advice:

    Considering most, even if they were paid out, would NOT get the cash since it would be used to pay off the overdraft and other bills still owing. I highly doubt anyone is planning to get the cash in their hands.

    However, please do not be a politician and avoid the question re asking Martin the question, are you asking him about Govan or am I?
    Let's not leave it to anyone's imagination with regards to that question.

  • Not sure if this is the correct place in the forum and if not I'm sorry. I have received a letter from Halifax Bank stating I have 8 weeks to respond or my claim for unfair charges will be closed. What do I do now?
    Also am I being cynical but has the supreme court been acting under orders from their political masters so they rejected the OFT complaint to save the government having to pay out through all the nationalised banks?

    Yes to the political masters question(you are being cynical) and hopefully clarifying the 8 week issue shortly.

    I received a letter from Natwest telling me of the outcome of the supreme court ruling.
    They basically said that they are "satisfied that charges i seek to reclaim were properly charged."
    If this is so, i wonder why they had chosen to drop the bank charges from £38 to £5? maybe something to argue on there?
    Anyway, i want to know if there is another means of arguing the case.
    I ask because in the letter they state that if they don't hear from within 8 weeks that they will consider the matter closed.
