in responce to Kingboyk the First Direct account you have is HSBC's online bank and so will more than likely be using the same standard letters across there banking network.0

Posted on the previous threads about the claim I sent in to Abbey for my hubby.
He just got his standard letter stating they will not be upholding his complaint due to the Supreme Court decision - they put the claim on hold even though we stated the charges had put us in financial difficulty (we live on Benefits and got into huge arrears on our mortgage as at the time we claimed the DWP were only paying a proportion of our mortgage interest - I ended up having to claim my pension early on ill-health grounds to clear the arrears as we were being threatened with repossession.)
It also states that if the complaint relates to something other than the level of charges we should contact them within 8 weeks or our case will be closed.
It doesn't even have an exact date on the letter just December 2009 !! Can anyone point me in the direction of other reasons we could use for why they should uphold our claim please?0 -

Not at the moment.
MSE Martin has been promising to publish new legal arguements - latest date is 3rd week in January now but it has already been pushed back a few times:

Best bet is to sign up to the MSE newsletter and you'll be one of the first to know when they are published.
But please note that Martin's advice is to consider you'll get nothing, but cross your fingers. It's not an easy legal arguement (hence the contining delay in publishing the new arguments) so no guarantees even when the new template letters are published."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -

If you sent a letter to Abbey they should have at least assessed you for financial hardship.

The above was pre Supreme Court decision but it is still valid since the FSA Waiver mainly made sure banks did what they should have done already.
They are currently sending letters out en masse. Furthermore, have you contacted your mortgage provider with regards to payment difficulties and what have they said?0 -
Hi, I was wondering if anyone could help? I have 2 separate bank accounts with Halifax, I've had that many charges on both that one has been closed because of it, do I claim for them both together or make separate claims?0

At the moment I would wait for further advice from Martin later this month before proceeding with reclaiming.0 -
I have also had an '8 week'letter from Barclays, is there no one who can tell us all what we should do? Time is of the essence.0

Hi I had an Alliance and Lester account in 2008, I went in and closed my account but the person serving failed to inform me there were charges pending on my account, therefore because I closed it there were no funds to cover the charge and I have sice been chrged more based on this one so I now have to give them about £200 I have objected to these fees as it was the fault of one of their staff, I would like to know what to do next since the banks won and the charges are no longer on hold.0

Hi guys just wanted to get some advice on my claim for charges refund.I made a claim for around £5000 back in september last year and it was refused.During this time i sent in my expenses form which they gave me, obviously to no use.A while later a Halifax advisor phoned me to discuss my financial situation and agreed that i had more going out than coming in.I wrote to the bank for a second time explaining that i wasnt happy with their review of my situation. This morning i received another letter saying that they are wanting to review my situation a second time and sent me another expenses form. How do you think i should go about it this time...milk it a bit more and see what happens?0
