Hi,
I have also recieved my 8 weeks to reply letter in relation to the carges on my HSBC account. Its a bit ridiculous as i have only just recieved the letter which is dated 18th December. Anyway to cut to the point this means i supposedly 11 days left until my bank disposes of my claim. What can i do to keep my claim open? Can i re-open my claim after they close it? Have i lost if i cant keep the case open long enough to get the new templates?
Im tying to claim £4000 back and dont want to keep fighting this. Please help?!?
Write them a letter and say you have just received their letter dated the 18th December and intend to send further details shortly as to why you dispute their findings.0 -
Hi, I hope someone can help me, I have been trying to reclaim my charges from the Halifax totaling £3500.00 under the financial hardship route. I received a letter on 19th January from them saying that due to my circumstances they would like to offer me a payment of £497.00 which is the amount of fees debited from my account between august 2009 and 19th January 2010. The offer is made without admission of liabillity and would be full and final settlement of my claim.
I am not sure if I can persue my claim and I dont really want to accept this offer as I want it all back. But due to the courts decision I don't know where I stand.

Just wanted to ask if there is any news on when the new guidance will be coming out from MSE? I realise that there will not be templates as such due to the nature of the potential new arguments and the fact that they are far more specific to individual cases.
I have received the usual standard letter from Halifax stating that I have 8 weeks to reply (Think I have 5 weeks left now). To cut a long story short, I suppose I am not in hardship as per the definition of expenditure massively exceeding income, however my personal circumstances changed dramatically last year with the birth of my first son, my partner is currently unable to work and so we are totally reliant on my income. This is just about enough to pay the mortgage, (My partners mortgage as it is her house) household bills etc but it does mean that we have to juggle payments around and have incurred charges on the account we pay the bills through when we have not had the money available.
I was claiming approx £4200 from Halifax in charges and had filled out an IE statement for them claiming hardship, they disputed that we were in hardship as we are not currently in arrears with the mortgage or council tax. I have 3 personal debts that are outstanding that I am unable to make payments on as all of my income now goes on supporting my partner and my son, Halifax does not consider them as priority debts however.
All of my charges stem from returned direct debits dating back up to 6 years, and these fees would allow us to clear some of my personal debt and get our heads above water.
I suppose I am looking for advice as to how to continue the complaint with Halifax? Which area it would be best to complain about? Which part of the regulations to use? Just what is the best way forward really so that the complaint is not closed?

It's out today. Came out a couple of hours after you posted I believe.
