Mihaita,
Please give CS/Returns a call to discuss your options - any advice given here is speculative at best.
Regards,
Hi there company representative. I was expecting your post. I'm on the phone in this very moment ''thank you for holding bla bla'' as you know. I trust more the advice that I am receiving on this forum than mobiles.co.uk staff's advice. No offence. I'm sorry for the lost called chasz but I don't blame him. Cheers0 -

Yes ....the best bet is to speak to O2 CS dept and they will advise you best ...they were realy helpfull with my problems with mobiles.co.uk

I had them on the phone earlier and they said that I can't cancel my contract because I used my SIM and handset. This is not a problem as I do need a mobile phone contract and O2 is fine with me but I want a good working phone. They also said that they are going to contact me in about one hour with other mobile phone offers. It's been two hours now
.
It's nonsense - disregard the rubbish they spout. The phone was not fit for purpose and you are within the seven days, regardless of using the sim. The network should be able to sort that one out, even if you have to pay for any use you made of it. You have a legal right to cancel although this company thinks it's above the law!0 -

Thanks for the ''speculative'' advice:rotfl: I had an O2 customer service adviser on the phone 10 min ago and he clearly specified me that I can cancel the contract within 14 days but he also said that this matter is to be discussed with mobiles.co.uk. Hopefully they will do the right thing... cancel everything. I changed my mind about keeping the contract and choosing another phone as they were supposed to call me back about 3 hrs ago... and when I call them they make me listen Twin Peaks song theme until i go mad. Thanks again!0 -
Hi there,
Please note cancellation is only possible within 7 working days of receiving the phone, not 14.
A faulty phone can be of course be cancelled even if it has been used - please speak to Returns to arrange this

Thanks for your reply. I had the O2 customer service on the phone earlier and they said that I have 14 days to change my mind and to cancel the contract. They also mentioned that this matter is to be discussed with mobiles.co.uk. You are right, looks like these guys think that they are above the law. I also did a huge mistake in the morning... before the phone to go bust. I placed another order with mobiles.co.uk to get a phone (not a clearance one this time but it doesn't matter) for my brother. So far I don't know if they accepted my order but if they did I'll send back the package the moment I receive it. Thanks again!0 -

I'll keep this in mind when mobiles.co.uk customer service is going to answer. Also a contract can be cancelled even if the SIM was used I'm sure of that.0 -

What you need to do now is cover all bases .....it's highly likely that mobiles.co.uk will try dragging their feet about giving you a returns number etc etc to get you past the deadline....so don't bother wasting any time package everything up and send it recorded delivery back to where it came from.
Enclose a short letter explaining you are cancelling the contract.
Get a copy of the recorded delivery receipt.
Speak to O2 CS and explain what you are doing and ask them for their nearest fax number and fax the copy of the returns receipt along with your contract details explaining that you have cancelled the contract and returned the phone and sim to the supplier.
Doing all that will cover any problems in the future and O2 will be fully aware of the situation.......If you made any calls using the sim I would imagine there will be a small chrge from them at the end of the day

Not true, and designed to make you feel you can only accept the advice of this (cpw) company! You really do follow Ben's advice at your peril!
Any advice you get here from the members (not from Ben) will be unbiased and actually intended to be helpful.0 -
Thanks for being so supportive and really helping make these forums a pleasant and unbiased venue for resolving customer issues - you do the community a real service.
