Is that a chargeback on PayPal? Since the guy spoke to me this monring then i replied asking for a full refund i havent heard from him which is strange. Im stuck in a catch 22 situation where if he dont communicate im going to be left out of pocket.
Not sure what to do as i havent heard from him since 11.300 -

In my partner's case he contacted his card issuer. There's two approaches you can take here, one is with PayPal and the other is with your credit card.
I can imagine it's a bit disconcerting not having heard from your guy since mentioning a refund, it is!, disconcerting. Your next step here is things do fall flat is going to be to contact PayPal and eBay to report a Goods Not Received As Described.
No matter how quiet or grumbling the seller gets, you are the one who is protected and is in the right. No, sellers do not want to give refunds, they think that they can just start selling stuff willy-nilly without taking on the responsibilities that every trader has to take on.
The law is on your side. We really need Soolin here, as I've said before as this is getting out of my depth. The final recourse is that you take the guy to a small claims court for breach of contract.
You're not going to end up out of pocket just that it may take some time.
Actually I did have something like this last year and the seller went quiet launching into an attack on how they have to deal with dishonest buyers. That was £20 so I let it ride. It was a long uphill struggle though, took about 2 weeks for them to send the item and when it turned up it was yellow stained from age, not "Excellent" condition as they'd described it.
Just hold on. Give it until Wednesday. But also prepare yourself for this not being sorted out for a few weeks. When you have got the money back just grab a 2nd hand TFT from the Free-Ads or locally via eBay.

Give the seller a little time. Not all of us do ebay 24/7My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

It might be worth letting him know that legally the item was covered because their TOS do not state anywhere that they don't cover flat panel monitors (remember, its NOT glass).
Just to get him on side, give and take etc - it might help speed him into giving you your money back quicker. If I was the seller in this situation and didn't know the facts i'd appreciate a point in the right direction.0 -

Thanks once again for all your replys. Hes now takign it direct to DHL and not through parcels2go as they have said that he could claim from them. The reason i dont wish for it to drag out is bacuase of the paypal 30 day rule. After 30 days they wont care and thats when it will get more confusing.0 -
I got my daughter a TFT last month and DHL delivered it, if they claim it doesnt cover tfts then I am sure they loose a lot of buisness.

The seller has responded this morning refusing to give me a refund untill DHL have settled the claim.
Is there anything i can legally do as i need to get this monitor replaced.

Paypal has a time limit on claiming. I suggest if you get close to this date, file a dispute with paypal.... there's no arguing with that. (But it will cost your seller more money, and annoy him a lot, so I'd leave it as a last resort)
Obviously your seller doesn't want to be out of pocket until DHL get their act together. Have you any idea when he expects to be compensated?My TV is broken!

Well he said hes filing a report today which im not sure how long it will take. Like you said if its too long as i believe PayPal only allow 30 days to claim so if it takes longer then this im not secured via PayPal and then i will end out of pocket?
As stated on this thread i emiled him saying DHL dont have anything to do with me as the buyer so hes the one who legally has to give me the refund?
