ts_aly2000 wrote:The laws, particularly contract law involving deliveries, goes back hundreds of years back to the days of highwaymen and !!!!!! Turpin. When you see in eBay advertisements that the seller isn't responsible, it's rubbish, and proves how little they know about the law. PayPal ALWAYS sides with the buyer regarding problematic deliveries, much to the squeeling and whining that the seller said it wasn't their problem. If there's one thing PayPal knows all too well, it's the law. Luckily this being the UK we have laws which go back to the 1300's which apply today. Certainly the delivery ones PP seems to have cast in stone.
It will work out don't worry
Thanks once again for the kind words you at least give me some hope as i do really hold little hope.
Is their a way i could contact Paypal to let them know about this? I obvosuly dont want to file a claim against the buyer yet as he will get notified then most likly wont care about trying to get the screen compensated by DHL?
Also im not 100% sure but dont you have 30 days only to file a claim for a purchase via PayPal?
This is the first time after around 200 transactions on eBay anything has ever been damaged in the post or ive had to claim so im quite unsure where i stand and what i can do.
Any information here espically if i couldlet PayPal know in due course the procedings of this item and the action we are taking.
Thanks,
Darren0 -
Trouble is that PayPal are so big with so many things going on, the courtesy of providing them information won't go too far. Having worked in one of these places (WorldPay) you tend to have the majority of emails which fall into different categories requiring action. The ones submitting information regarding updates or possibilities lose importance. But I know exactly where you're coming from though.
Just hold on till MondayThat'll be when things start to get moving.
Regarding this signing for goods as received, delivery drivers aren't too chuffed if you start opening packages, as they won't let you open them until you've signed for it...
Darren, I'm tempted to say that this is going to end up as a PayPal chargeback.
We really need Soolin (another user, is a moderator) to comment here as he's quite sensible about the outcomes of these things.
Don't file a claim until late next week depending on the outcome. The seller might be fine.He may get the money out of DHL. Truth is, the way they treat those boxes... It's more that they get thrown about and crammed onto roll pallets rather than any deliberate damage, they're just careless more than intentionally damaging things.
This will work out and we'll be here to help you on the way.0 -
I agree, stay on good terms with the seller. Give him a proper opportunity to sort things out for you - this may well take a little bit of time as he has to get to the bottom of things via Parcelstogo and DHL.
As you paid via paypal you're in quite a strong position - if the seller does let you down (let's hope he doesn't) you'll have other ways of resolving the situation.
By the way, as regards refunds: you can't expect to be refunded before the item has been returned to the seller. If you bought mouldy bread in Tesco, do you think they'd give you a refund without seeing the state it was in?My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
First and formost thanks for all the support and help. It gives me a brighter outlook on things.
frivolous_fay i knwo where your coming from saying about refunds in day to day busniess. But buying something from a unkown i you like seller on eBay is different. I wouldnt have any protection would i if i sent the monitor back?? Im not sure so thats why id be hesitant.
Il leave PayPal for now and as the seller has so far to date been helpful il see how things progress from Monday.
Once again thanks for all the help, tips and support. Hope i can return the favour one day!
Il keep you updated!0 -

It's up to you to take steps to protect yourself in this eventuality: in the case of a postal delivery, items must be returned via a trackable method to be covered by paypal's guidelines. (It proves it went back to the seller, in case of a dispute later) It should be easier for you if DHL is being used - I believe it's all electronically tracked.
If it's sent back - keep all documentation, reference numbers, the lot.My TV is broken!

FAQ'S Mentions monitors
12. Is it possible to send a large screen monitor/television?
We are unable to deliver anything over 4 cubic feet in size and 25kg in weight, please refer to our terms and conditions of carriage as ANY glass items are not covered by our insurance.
Seems as long as its within size/weight its okay BUT
17. Am I covered by your insurance if I send a monitor or television?
You are covered against loss but we can not insure your packages against damage. The same applies for all items containing glass.
Damage is not covered.
It seems communication with the seller will be your way forward for a refund0 -
I can only reitterate what other posters have said, Parcel2go do not cover glass items, if you try to book a parcel and type in a description like monitor or screen you get a warning about the lack of insurance. I just hope your seller looks after you.
I have taken a risk when sending screens before and changed my description to 'electrical equipment' but i would not risk that again after your experience.
Good luck.WHOOOOSHHHHHHHHH……..
Blimey what was that ?

Oh I wasn’t quite ready can I have another go ?

Thanks,
Il highlight this information to the seller. If he dosent respond i will speak to PayPal tommorow. If they have those terms on their site think i guess i have got no chance of getting any sort of compensation through DHL its going to have to be from the seller.
