it not neccersarily living beyond there means i always keep with in my means but we all have to pay tv licence gas and electric and these all demand to be paid by direct debit so you set up the date you get your money say the 15th yet they dont try to take it out on the 15th they take it out on the 13th or the 14th which gets failed and then you get charged

People make mistakes and I have forgotten to pay my credit card once and got a £12 charge, as it was the first time I called them up and they refunded and I think most banks would do the same.
If the banks would have lost then it would have meant the end of free banking, free cash withdrawls and the like which means the majority of us would have suffered for the few who can not deal with money.
As for Martin Lewis, his smug grin annoys me at the best of times - It has been wiped off for now but hes made a fortune out of this and coming accross as the 'consumer king' when in reality hes a jumped up t###er who took on the big boys and got a beating.:money:
The banks are a business, in it to make money - If you don't like it then (1) dont go overdrawn, learn to count (2) goto another bank if you dont like yours (3) get a kiddies account or passbook account that doesnt allow you to spend more than you have and once you have mastered the art of 'budgeting' then you may be trusted with a cashcard.
Thank god for common sense by the courts for once, and as for the comments the court was 'bribed' come on, try and get out more (without spending money obviously as you dont want that overdraft to increase).

They have not. And they are not legal. The ruling says that banks can charge for unauthorised overdrafts. But the law says that they cannot be punitive. So putting a punitive charge in the T&Cs is not enforceable because it is not legal.
If I put a clause in a contract that says I will torch someone's house if they don't pay by a certain date, that doesn't mean I can do it. It is still illegal. This is exactly the same thing.

Thats xmas b******ed for those hoping for the banks to subsidise it with some festive refunds.
I genuinely feel sorry for people struggling with debt, I've been there myself and learned the hard way to live within my means .Banks are businesses and will charge what they think they can get away with and it looks so far that they are getting away with it, time will tell if this comes back round in favour of ordinary people, but the cause is not helped by the reckless and careless who make up a significant amount of the people trying to claim back charges.
I for one do not want to see someone who cannot control their spending being subsidised for their own profligacy.However thoise who are sucked deeper into debt by being charged for being charged etc on a piffling debt or missing one payment i do have some sympathy for.
If there is a lesson to be learned, I suppose it is get your house in order, contact your bank if things are a bit tight and try and work out on overdraft arrangement.I just wonder if the banks will listengarth;)0 -

The direct debit guarantee applies to all banks and building societies taking part in the direct debit scheme. It says that:
If there is a change in the amount to be paid or the payment date, the person receiving the payment (the originator) must notify the customer in advance.
If the originator or the bank/building society makes an error, the customer is guaranteed a full and immediate refund of the amount paid.
Customers can cancel a direct debit at any time by writing to their bank or building society.
