The banks did.
And if (although they were never going too due to the state of this country) the banks lost this appeal, they would have been allowed to again, and again and again until they got the decision.

Come on people, don't lower yourselves to replying to the trolls on here, they are only looking for a responce due to the lack of love they received as a child (and probably still now)0 -

I was wondering how long it would take to get into a slanging match0 -
Those who are suggesting that Lord Phillips et al are corrupt should really think before they post such statements. Such statements are potentially libellous, and go completely against the ethos of MSE.
It is clear from posts prior to 9.45am that many people thought that the OFT winning the case was a foregone conclusion. Unfortunately for these people, they were quite misguided.
Yes I thought about my statement and its my view. This is a forum for free speech and opinions.
As the famous quote by Lord Acton goes:
"Power tends to corrupt, and absolute power corrupts absolutely. Great men are always bad men."Why buy when you can win!
BEST WINS 2009: SONY BRAVIA TV SONY BLU-RAY PLAYER

I don't think the reputation of Martin Lewis has been hit for six - if that's your view, perhaps you should consider expressing it somewhere other than his website.....
I am grateful for the way he has stood up for the general public, who else is prepared to do that?
This decision is disappointing obviously. But just because I have been awaiting a payout for charges doesn't mean I have the inability to manage my finances - you know nothing about peoples circumstances at all.
Here, here. Always look at things positively. Martin, the Consumer Action Group and Which magazine have served us all proud. They were simply trying to redress the balance. They saw wrong and tried to put things right.0 -

So the UK will print out money to save the banks, but wont print out money to save the puplic???
pay back the unlawful charges and this WILL help the recession, people with debts will use the money to pay them off and people with no debts will spend!!
isnt this what the government want????0 -

If you do spend £101 and you signed an agreement saying an 'UNAUTHORISED' overdraft will cost you £35 then you have to pay the £35
People make mistakes and I have forgotten to pay my credit card once and got a £12 charge, as it was the first time I called them up and they refunded and I think most banks would do the same.
If the banks would have lost then it would have meant the end of free banking, free cash withdrawls and the like which means the majority of us would have suffered for the few who can not deal with money.
As for Martin Lewis, his smug grin annoys me at the best of times - It has been wiped off for now but hes made a fortune out of this and coming accross as the 'consumer king' when in reality hes a jumped up t###er who took on the big boys and got a beating.:money:
The banks are a business, in it to make money - If you don't like it then (1) dont go overdrawn, learn to count (2) goto another bank if you dont like yours (3) get a kiddies account or passbook account that doesnt allow you to spend more than you have and once you have mastered the art of 'budgeting' then you may be trusted with a cashcard.
Thank god for common sense by the courts for once, and as for the comments the court was 'bribed' come on, try and get out more (without spending money obviously as you dont want that overdraft to increase).
A good day for the MAJORITY of people out there who are FED UP of supporting idiots and others who get themselves in the s##t and want bailing out :T:T:T:T:T
I'm so pleased you have never had any money worries in your life, it must be a great way to live, unfortuneately when you are a student and are hit by a £30 charge it throws your whole budget out and when you get charged for being charged it does seem a little unfair. So yes I agree with you people should manage their money better and only pay for what the can afford, I now have no overdraft as a matter of choice so I do not live beyond my means and get into a sticky situation again, but banks should also provide a much better service for these 'charges' in my experience trying to speak to someone and explain a situation to them is near impossible with most banks, it seems to be a case of 'computer says no' in most cases!
I'd more than happily pay an agreed anual/ monthly charge if that would enable me to speak to a finanacial professional (ie bank manager) if there was an issue with my account.
However everyone is entitled to their own opinion and thank god we live in a country where free speech is allowed.0 -

I dont think there is anything wrong with having a different opinion, but both you and hallowed have picked a bad day to be on this site a) slagging off Martin, and b) being all smug and righteous. There are people in genuine hardship,....and you do not know the circumstances we all live in.0
